Insinuation regarding a seller's complaint which I found offensive

I have recently tried to purchase a Jim Shore Organ players figure four times!  One from a private seller and three from Ebay.  Obviously I really want this figure but have now given up that I will ever receive an intact item.  The three purchases I have ordered from Ebay have all arrived broken (as did the one I received from the private seller which was a nightmare, enough said not Ebay) in exactly the same way with the organ pipes broken off the organ and other broken parts.   The three I ordered from Ebay all arrived in destroyed boxes r/t mail  handling I'm assuming.  At any time there was never more than one order in my house at a time as I wouldn't order the next item until the previous order was on its return to the seller's address.  I even mentioned in ordering to please pack carefully relating previous experience each time.  Upon receipt on all three orders it didn't appear that the items were even checked before sending as the inside contents were undisturbed without new tape or anything disturbed.  Even Disney admits some of their items are so fragile they no longer sell said items since they appear to break just moving them around.  This last return the seller said he marks his figures in a secret way (that's fine probably good practice) so he knows he has received the right one back.  Upon his receipt he said the one he received did not have the mark insinuating I sent back a damaged one and kept an intact one.  Now I know it's his word against mine but Ebay's response "After reviewing your case, it appears that the item was returned in a different condition from how it was shipped. However, in this case, you'll still receive a refund.  Again insinuating I was at fault.  I think their customer service response should not be so accusatory that I was dishonest in my dealings with the seller.  I know I am just ventilating because I'm angry but Ebay doesn't want to hear it.

eBay doesn't sell items - they only sell ad space to sellers. You bought all your items from individual sellers. I'm thinking you may have bought three of them from the same seller and he may have a lot of stock that is damaged.

 

If the item arrived damaged, the seller is at fault, and you are owed a refund. However, eBay does keep statistics on cases opened by buyers, and I would hate to see your ability to return items restricted because you open too many of them.

 

If you are going to attempt to buy another one, be sure you are buying from a STELLAR seller. (That item does look like it would be a challenge to ship.)
