I received wrong item and my return request was denied by seller who calmed to sent me a replacement

I bought a item from seller for 30+ doaller he sent me the wrong item , he originally wanted me to send it to the right buyer but I was uncomfortable with that , after this I said I would return he said I could keep it he is sending new item anyway, well after months of nothin I requested a return for refund and he denied it I want to file a dispute as I have photos of the item still in shipping package and photo of conversation but I can't get ahold of a agent because of this terrible ebay customer service system if anyone can please help me as the seller is saying the item was delivered whice is a utter lie please help as I can't even get past ebay's incompetent automated system !

It sounds like you opened a not received claim, when you wanted to open a not as described return.

If you received the item less than 30 days ago, you can still open a return.

Go to your purchase history - select return this item.  Click see more under the reasons and select does not match the description, and follow the prompts.

The seller has 3 business days to send you a return label or a refund.  If he doesn't, or says he can not send a label, go to your case and click 'ask us to step in'.

If it is too late to open a return on eBay, and you paid through a paypal account, you can open a not as described dispute there.  Join their return shipping program before you do.

If you paid directly with a credit card, call you card issuer and ask if their buyer protection can help.
