I did not get the package.

I got the message in email that package has delivered. But actually it did not. When I started to complain to E-bay, I got the answer from them that the package is on its way.

Who is right - the Post Office people who said that package has arrived or E-bay people who said that it is still on its way?

I did not get the package.

The USPS link to eBay is not always updated.  So the USPS site may say the package was delivered but what the eBay reps see is that it is still in transit.  You have to go by the USPS tracking as it is the most accurate.

 

Your problem is that eBay sees the package still in transit so will not do anything about a not delivered case yet.  You need to find out from the USPS the GPS location of the delivery.  If it is at your location or very close eBay will rule in the sellers favor.  For you to win a "Not Delivered" appeal (eBay will rule in the sellers favor initially) you need to prove that the address on the package was not yours.  The USPS may be able to provide a letter (not an email) stating the address on the label was not yours.  Then you would appeal using this letter as proof.
