How to open second issue after first has been holding

Dear Friends!

I bought the ipad and didn't arrived on time, so I opened issue item doesn't arrived, after that the ebay holding my issue 2 weeks because seller give the trucking number to ebay, but now my item arrive but it doesn't match with description (Activation Lock require) so now what should i do for open second issue about item doesn't match description ? 

Note:

Now I sent email to seller about this case but haven't gotten reply yet, so if the seller not reply I should to close my first issue and then open second issue? or what should i do? please advice me...
