What category was the mini excavator listed in?

The regular claim process may not be the correct claim to follow.

The appropriate claim to file is the Business Equipment Purchase protection.

What’s covered?

If you buy an eligible item for $1,000 or more, you’re automatically covered in the following situations:

  • You paid for an eligible item but didn’t receive it
  • You paid a deposit on an eligible item but didn’t receive it
  • You paid for and received an eligible item that you can’t legally own because:
    • It’s stolen property
    • It’s subject to an undisclosed or unknown lien
  • You paid for and received an eligible item that’s a different type, make, or model than what was described in the listing, provided the amount of devaluation to the item due to the misrepresentation exceeds $1,500
  • You paid for and received an eligible item with undisclosed damage, provided the cost of necessary repairs exceeds $1,500 and the item was advertised as being less than 20 years old. The program covers only defects and damages that prevent the equipment from functioning, not defects or damages that are cosmetic or not critical to operating the equipment

Please see the reply on what to do if it was listed in Business Equipment.

My answer is ONLY valid if the item was NOT listed in the Business Equipment section.

Look for the last estimated delivery date in your purchase history. You can file a refund request when the item is at least a day late.

You have 30 days from the last estimated delivery date to file a refund request on eBay.

Select your item on this page to start a refund request:

https://www.ebay.com/help/buying/returns-refunds/get-help-item-hasnt-arrived?id=4042&st=

4 business days after you file the refund request ask eBay to step in and help if the seller has not refunded you.

https://www.ebay.com/help/buying/returns-refunds/ask-ebay-to-step-in?id=4701

If it is more than 30 days past the last estimated delivery date then you can file a refund request on PayPal up to 180 days from the date of purchase. OR if you didn't use PayPal at checkout contact your bank or credit card to report that you didn't receive the item.

Ebay has a 30-day Money Back Guarantee for Buyer Purchase Protection. If you go to your Purchase History and select the item, go to the Order Details and that should show you the estimated delivery date. Once it is one day past that date, you would need to open an Item Not Received refund request. EBay will not get involved unless you open that request on time. This is even if the Seller is no longer on eBay.

If it has been more than 30 days since you paid, you may need to open a chargeback with your payment company. Only do that if it's too late to open the request on eBay.

Should you need to start a chargeback, it will be your payment company that makes the refund decision, not eBay.

I'm sorry this happened to you.
