I ordered a mini excavator, the seller is no longer on ebay, did not ship the miniex but took the money from my account. I have spoke to an ebay representative 3 times but no help, they told me to call back bur it's automated and no help. What can I do to get my $2,997.83 back from ebay?

What category was the mini excavator listed in?
The regular claim process may not be the correct claim to follow.
The appropriate claim to file is the Business Equipment Purchase protection.

My answer is ONLY valid if the item was NOT listed in the Business Equipment section.
Look for the last estimated delivery date in your purchase history. You can file a refund request when the item is at least a day late.
You have 30 days from the last estimated delivery date to file a refund request on eBay.

4 business days after you file the refund request ask eBay to step in and help if the seller has not refunded you.

If it is more than 30 days past the last estimated delivery date then you can file a refund request on PayPal up to 180 days from the date of purchase. OR if you didn't use PayPal at checkout contact your bank or credit card to report that you didn't receive the item.

Ebay has a 30-day Money Back Guarantee for Buyer Purchase Protection. If you go to your Purchase History and select the item, go to the Order Details and that should show you the estimated delivery date. Once it is one day past that date, you would need to open an Item Not Received refund request. EBay will not get involved unless you open that request on time. This is even if the Seller is no longer on eBay.
If it has been more than 30 days since you paid, you may need to open a chargeback with your payment company. Only do that if it's too late to open the request on eBay.
Should you need to start a chargeback, it will be your payment company that makes the refund decision, not eBay.
