What can be done about a seller that sells items they don't have ? I ordered from a seller that was waiting on my order to be sent to them. It's been 18 days and they say that my order has been shipped, but there's still no tracking number. I have spent thousands with ebay, but swear it will not happen again. I'm tired of being treated like an inferior idiot, while the seller can do no wrong.

Do you check the estimated delivery before you make your purchase? That is the date you agree to. You can open a claim after that date. eBay depends on customer claims to catch sellers who repeatedly do not deliver as promised.
After the last expected delivery date, but no more than 30 days after the last expected delivery date, go to your purchase history - select 'I haven't received it' and follow the prompts.
The seller has 3 business days to provide tracking that shows delivery, or a refund. If he doesn't, go to your case and click 'ask us to step in'.
