When the buyer files an Item Not Received case, and it is after the last estimated delivery date, you have 3 days to reply with a tracking number that shows DELIVERED, or a full refund. If you do neither, and the buyer has to Ask ebay to step in, it is at that point that a defect is recorded on your account, regardless of the outcome. As a seller, you do whatever you need to do so the buyer does not Ask ebay to step in.
