Bad listing

If a seller doesn't plan to take an "or best offer" for an item listed at $9.95, then don't post it for $9.95. That's false advertising!

Are you saying you offered them $9.95 and they declined the offer.

A seller is under NO obligation to accept any Best Offer for whatever price.  If you want to buy it at $9.95 then use the Buy It Now or Add to Cart button.  There is no "false advertising" because there is no promise to accept any particular amount in a Best Offer (and Best Offers equal to or higher than the BIN price is a red flag that the offeror is a scammer or other problem "buyer").

 

That's even if they deliberately added Best Offer to the listing, which in many if not most cases they did not.  eBay makes that a hard-to-remove default and even if you do remove it they still might add the BIN button if they feel like it.

That is certainly a seller not using the function as intended.  But there is no way to force the seller to take your offer, sorry.
