Awaiting eBay Appeals Team Response: Seller gave partial refund instead of full.

I am wondering if anyone else has had this problem happen to them. I purchased two items. The one item I got was fine and I kept it. The other item, had significant amounts of damage. In the listing the seller only showed a cardboard box that was never opened. The seller in the past has refused to open sealed cardboard boxes. I purchased the item anyway because of eBay's buyer protection policy guarantee, "get the item you ordered, or get your money back." I contacted the seller and gave photos of the item with the damage. The seller said send it back and I got a prepaid shipping label. The seller received the return and did not provide me with a full refund as required by eBay's money back guarantee policy. Instead the seller only gave me a partial refund because seller claimed item was not in same condition as sent. That is not true at all. I did open the cardboard box to see what the item looked like, which was a Code 3 Collectibles The Village's Sutphen Tower Ladder Truck 51. How else are you going to see the contents of an item and condition unless you open the box? How would seller know condition of item, if she did not open the cardboard box? If cardboard box was opened, seller and buyer would have seen the damage. I would not have bought the item.

 

The seller messaged me and said that eBay would take care of the rest of the refund. I was told by an eBay representative that because she is a so called high volume seller, she can give a partial refund instead of a full refund. After receiving the partial refund, the return case was closed. I have never heard of this. The appeals team is supposedly looking into this and working on getting me a full refund which I should have gotten initially according to eBay buyer protection guarantee. It has been close to a week and no response from the appeals team yet. However, seller has the item and the money. I don't have the item or the full refund. Has anyone else experienced this? What should I do? Every time I call eBay, they just forward my case to the appeals team. I don't feel eBay is holding up there end of there policy. I don't know why after seller said eBay should return the rest of my money, eBay has not yet.
