I'm in the process of asking about a refund for an item that didn't work and it says that I can ask Ebay to step in and help within 3 days if a solution is not found. Tomorrow is the last day for me to ask and I'm just wondering if I still have a chance to ask tomorrow if it is stop on the last day given. The seller is in china and they're responses are very slow for me. They said they will send me a new item but I would prefer the refund. I'm just wondering if I would still have time to fix this if it went over the day I was given to ask for help.

The seller gets 3 business days to respond to a request. You get more time - 21 days from when you open the request to ask eBay to step in, or 10 days after a refund is due if the item is returned.
I would not accept the promise of a replacement - tell the seller you want a refund now. He will try to delay until it is too late for eBay to help, so I would ask eBay to step in as soon as the option shows in your request.
