Antagonistic Seller

 

This seller, who shall remain nameless unless needed to be exposed, sent via UPS,  a package that had the two items wedged in an undersized box.  The contents were model train cars whose couplings were broken off, a pin that would have originally been connecting the one coupling was missing indicating, to me at least, that one item was broken prior to shipment.

No damage was visible on the box itself, except for the bulge because it was forced closed.

The vendor filed a claim with UPS.

UPS called to ask me about the damaged package. I explained to UPS that the box, now long gone, had no apparent damage and what the the condition of the items and packing was inside the box.
There was no evidence the box suffered any force capable of the breakage if the items were packaged correctly.
 
A partial review of the correspondence prior to today is as follows:
Vendor -
"Hi . your message did not come through.. please send close up pics of broken parts and or a list ..like 2 couplers and spring ? And or what you want to fix the trains thx timmy"
I tried my best to be polite in my correspondence with the seller, repeating my messages several times because he claimed he did not receive them:
My reply(s) -
"Let's try this one more time.
I hope you are able to get this reply.
Image 7426 shows the damage.
The coupling, the pin connecting the coupling and the receiver that is attached to the truck.
If the receiver and attached coupling can be separated from the truck, it looks like the assembly is screwed to the truck.
If they cannot be detached, that two whole trucks with the coupling assemblies attached.
I saw no signs of any springs and sorry, as stated in the previous e-mail reply, the cars were shipped to another location where they will hopefully be coupled with an existing train."
 

After this message, the vendor started to rant and rave about getting a negative feedback from me - which I never left.

Vendor -

You leave bad feedback over mail damage ?????? ..and I was just letting you know I have made your claim and getting you a full refund and keep the trains ????? And just telling you I have 2 new truck assembly's packed to be sent to you ????? WOW how utterly dispicable... NOW it's my duty to totally destroy you on the feedback I'm going to leave You...and warn other good people about YOU...are you ignorent or just dum to the fact that you can be left feedback also??...and I'm gonna try my best to cancel your claim I put in because by the tone of your previous messages indicate that there is something definitely wrong with you..and I was required to show them your information . you must be one miserable person..but to do that is ...well let's just say I as a American God and country person...I would not want that kind of karma against me ..so Good Luck With That karma when in slaps you right in the back head .

I do apologise I mistakenly thought you left neg feedback..it was a honest mistake and I double checked before I left feedback and did not leave you bad feedback...it was very close to another item .. again very sorry and and now I'm 10 times more angry that some jerk from 2 months ago had a complaint and I resolved it and he just now left neg feedback..and I made a mistake and accused you ..very very embarrassed and sorry...
And then today -                                 Vendor - 
Hey dude.....I don't know how it works....never had anyone so blatinly blame me for mail damage.... But no da...they took your information off the receipt...so what is your problem ???? .I told you I would get you the refund you and let you keep the item .so enough of your **bleep** insinuating like you have been doing blaming a seller for mail damage and making outragis demands and insinuating like you are did and do . So now I will only except a return now from you AS PER YOUR agreement when you bought this .....next time learn some manners..and fallow the rules on here .and in life ...and if I was you l...earn how to treat people better because you will get it back 10 fold..what a weak sad state of demener you display. And over a toy at Christmas time.... .sad ... YOU ARE what I thought you were.
I looked at the comments for this vendor and saw that mine was not the only one that arrived damaged this month. There were two negative comments noted.
Am I wrong for thinking this guy needs help?

If you received an item that is not as described, open a return within 30 days of receipt using the option next to the transaction in your Purchase History. The seller will have 3 business days to provide a prepaid return shipping label or else refund. If he does neither, go back to the case on day 4 and use the option to ask eBay to step in. They will force the refund.

 

There is no need to go back and forth with a seller who behaves that way. And when all is said and done (i.e. you have your refund), feel free to leave appropriate feedback.

I did not have, nor wish to have, anymore contact with this vendor. The broken items were repaired.

I did not ask for a refund, only for the parts offered by the vendor to fix what was broken in shipment.

The vendor then stated a file was claimed against the shipping company, UPS, for damages and stated I would receive a refund and be able to keep the broken items.

UPS called to investigate the claim and asked for photos of the damaged box.

My reply to them was that there was no outside damage to the box, it bulged due to it being undersized for the items inside. as well as the items not being protected.

Although I did not have a photo of the box as it arrived, I did have photos of the box itself showing no exterior damage.

I could not honestly state that the box was damaged in shipment when there was no evidence to back it up.

The items were wedged in an undersized box and no protection was given to the protruding parts forced against the sides of the box.

The final determining item was the lack of  broken parts that would have been present inside the box if the damaged was due to shipment. 

My only request is to notify the community of the incident.

Antagonistic Seller

The seller is responsible for the damage.  Do as @inceptions instructed.  The seller either has to refund because the item was not as described, or he will have to provide a shipping label at his cost to have you return the item.  Either way, he has to refund.
