I ordered an action figure back in August from a Chinese seller (an experienced seller with decent reviews). It was a preorder so I had expected it to take a while and the seller sent me a random trinket with the original tracking number on the order in the meantime. The seller had taken off the listing a few months afterwards (and increased the price), not sure how it goes into things but just thought it was weird. Anyways, I kept waiting until I knew that the figure had been officially released and I started messaging the seller on updates. After a few months of messages back and forth from January till last Tuesday, the seller replied briefly often times with broken English and promised me that it would get delivered on the third week of March which it never did. I messaged again last Tuesday asking for the tracking number and the seller said that they would get it for me when they're "back in office." It just seems that they're always finding excuses and dragging on. I have no experience buying from Chinese sellers, I'm not sure what to do aside from keep waiting. I can ask for a refund, but what if they're actually just super slow. Any advice would be appreciated, thanks.

Sellers of presale items are required to provide the exact date the item becomes available in the listing and are also required to ship within 30 days of the sale. But users must know about the policy in order to use the Money Back Guarantee.
Sending a gift with a tracking number was likely an attempt by the seller to get around this policy and also to provide "proof" of delivery if you had disputed the transaction.
On eBay, buyers have up to thirty days from the last estimated shipping date shown in the Purchase History to file a case. After that, eBay can no longer help.
PayPal and most credit cards provide some protection for up to 180 days from the time of purchase. Check with your card issuer to see if you have any options remaining.
