Am I being scammed?

  I purchased a printer said to be in perfect condition, open box. Still in plastic with the blue shipping tape on it.  The original box and been wrapped in craft paper and taped all the way around. When it arrived, it looked perfectly good. After removing the tap and paper the box one side had a large hole punch into it and into the side of the printer. None of the photos in the auction showed that side of the box.

I contacted the seller and he acted surprised. He had purchased eBay insurance for shipping. 

 So, my questions are, Does eBay pay the buyer or the seller? Should I return this to the seller? Is the seller going to get my money and the insurance?

Go to your purchase history and click return item and select, the item doesn't match the description as the reason.
The seller will have 3 days to accept the return and pay return shipping or refund without returning.
If they don't, return to the case on day 4 and ask Ebay to step in.

 

If the seller wants to file an insurance claim, they should refund you and have you hang on to the package and item so it can be inspected.

You should request a return.  The insurance is for the seller.   Ask the seller is he wants photos for his insurance claim.  If the item was just wrapped in craft paper, I doubt that the claim will be paid.  You do not wait for the claim to get your money back from the seller.

 

Go to your purchase history and click return this item. Then click show more under the list of reasons so you can select 'doesn't match description'.

The seller has 3 business days to send you a return label or issue a refund. If he doesn't send a label or says he can’t send a label, go to your return and click 'ask us to step in'.

 

If he asks you to hold the item for inspection, tell him that he must issue the refund now (after providing the return label)  - then you can hold it until he asks you to send it.
