please help...

For an item I made an offer, next day (8th of August) my offer accepted, at that time I noticed that the seller was really suspicious wth his very bad reviews, but in order not to break my commitment I paid on th 8th of  August and the item was supposed to be delivered by the 16th of August... but the Seller waited only, no communication, no shipping, no cancelling... then finally a week later shipped it on the 15 th of August evening... Obviously not gona make it by the estimated delivery time (16 th of August).. and now there is a new estimated delivery time (19th of August)... I dont want this item, I dont want to buy from this scam seller, but I dont know my rights (if there are any) so pls help...

If the seller shipped and tracking shows movement, you're going to have to wait for it to arrive. If it doesn't come by August 19, on the 20th, go to the transaction and click that you haven't received it yet. 

 

Seller will have to respond with tracking and if delivery isn't shown, eventually, you'll get a refund.

Alberta really only answered half of your question. That has to do with actually receiving the item you claim you don't want. If you don't have tracking for the item, or don't receive the item around the delivery date, you can file an INR (item not received) case in your purchase history, filing for return for the item, and selecting that option.

 

IF (and when) the item arrives, if it is as described in the listing, it's yours. You bought it. Keep it, donate it, sell it, your choice.

 

YOUR RIGHTS. As stated, if you don't receive it and/or don't have tracking info (if tracking info shows it is stuck in a USPS distribution site, be patient, not the sellers fault) you can file INR return (item not received). If the item comes broken, damaged, not as described, or you receive something other than advertised or an empty box or some sort of scam (since you say this is a scam seller or so you think) then you can file the appropriate case for return such as item not as described (often referred to as SNAD).

 

Again, only do these if these things apply such as receiving a not as described item or not receiving a package. If this was not a scam and the seller sends you the correct item and just shipped it late, they got their "ding" in ebay's eyes via their service metrics and it hurts how ebay (corporate) treats their account. You still will have received the correct item you committed to buying and what you do with it (keep, donate, sell, toss) is up to you.

Do come back to update us and let us know if you do have tracking for the item, and again at delivery time, if you receive the package or not and if it is the correct item or not, if a case needs to be filed you can receive more advice here.

Go back in your Purchase History and find this transaction.

Look at the last estimated delivery date.  If that was the 16th, that IS the estimated delivery date.

It can't be changed after the purchase was made.

That was an ESTIMATED DELIVERY DATE.  IF your seller is on the opposite side of the country from you, most of the times, those dates are off.  Anyway,  sometimes sellers can have an emergency or they went away for a weekend.  You can show some patience and wait and have a heart.  No need to post a negative.  Remember, most sellers here are just plain folks and not a big company.  They may have a job and/or family.

 

Also don't assume you will be refunded if the item doesn't get to you by the second ESTIMATED DELIVERY DATE.    If the tracking shows movement, the seller can ask for an extension before giving a refund.  He can also recall the package (if it's priority mail) to make sure that you do not get the  item for free.
