Refund & return

I sold a model locomotive for $100.00, plus $9.00 for shipping.   When it arrived, the buyer claimed it was broken & opened a return case.  The next day Paypal gave him his money back.  $109.00.  Now he has the locomotive & all of his money.I contacted him & he says he will not give me the model or the money.  Worse yet,  The return case page says the money has not been refunded & is preparing to issue him another refund of $109.00 on the 26th of this monthe.  I will out the locomotive & 218.00. My lawyer says to do everything to get my money or the locomotive, then if nothing happens, we will file a damage suit against Paypal Ebay, & the buyer. Ispoke with Michael, (Ebay Rep),  & he says he will send an email to the buyer requesting he return the locomotive or the money.   This did nothing.  What options do I still have, other than going to court ?

Open up the Paypal transaction. What exactly does it say? Are you SURE the buyer has been refunded already? When a case is opened against you, the funds are frozen and your balance will be lowered by that amount. The buyer can only get a refund if the tracking number on the return label shows delivered.
