I recently bought a pair of samsung "iconx" earbuds.
In the description of the listing it was stated that the item is unused and brand new, and is excluded warranty. I assumed that it's safe to buy because the item was new and I thought I can manage without warranty, but the device arrived with one earbud not working properly.
What do I do? I have been contacting the seller but all I'm getting back from him are responses that he is 100% sure he sent me a genuine and flawless item.
I also offered the seller a return, but he ignored my request. Instead, he messaged me that he reported me to eBay, and that'a so absurd because I have way more feedback than him and I bought items worth more and never had such inconeniences before.

file the- item as not as decribed- read the buyer protection policy for a better understanding
have so many days in which to do that--don't let the seller string you along passed the last day to file.
ps; feedback count has little to do with your situation
