Possible Scam?

so I bought a PS vita and the guy said he would ship it out well tracking hasnt updated since he shipped it out still sitting at "waiting for package drop off" since 1/31 when I contacted him about he responded with that usps held his package because he needed to replace the label(ebay label). still hasnt updated since he did that yesterday so im assuming he never shipped it off and just hopes I forget about it and wait so it can drop into his account in 21 days. if so shoiuld just wait until when its expected tuesday? and open a dispute?

small update: apparently there is new tracking he added yesterday which hasnt updated either -W-

You have no choice but to wait. Ebay won't allow a case to be opened until 1 day after the latest delivery estimate. Therefore it makes no sense worrying and wondering at this point.

well thats tuesday which is the day its supposed to be delivered and yea just sucks having 200 wrapped up in something and just wasting time

Wait until you can open a dispute, then open it. You can't open a dispute before eBay allows you.

Unfortunately, you can't waste time which hasn't arrived.

Have you contacted PayPal for a short t5erm bridge loan for the 200 until this is resolved?
