Okay, I admit it, I need help. Return Dispute

Okay, heyyy there, this problem is gonna sound really stupid but I'm finally at the point where I need to reach out for help, to the people who would know the most about it. Please bear with me.

 

A bit of context, hi, I'm an artist! I've been shopping around for a screened tablet to take on the go that I could draw on. So, after some research, I settled on a Microsoft Surface. I came to eBay to find one, and also hi you can probably tell my account is very new. I'm not entirely familiar with the eBay culture or language and stuff like that.

So I found this REALLY CHEAP listing (seriously, it ended up being 97$, wow) for a "Microsoft Surface Pro Pro". I looked it up a few times but couldn't figure out what a Pro Pro could be, but I was sure it'd be fine because it was so cheap. Now that I'm saying this I'm seeing my mistake. Anyways, it showed up, and it was a Pro 1, the very first type they'd made. I'm okay with older tech, I thought it'd be fine... it wasn't, it sucked. It wasn't reset properly, so I had to go to Walmart and briefly break open a keyboard to do that, and it had some oily splatter on it (soup? I also neglected to take a pic because I just simply cleaned it off, darn) and it has a small scratch in the middle of the screen that wasn't listed. I got a smart pen too and it wouldn't pair because whoops the model is too old. It also runs like a small sun and, didn't burn me, but having it on my lap a while started to hurt. After a seriously frustrating night, I got some packing supplies, taped it up and sent a return request. All these reasons I had sound superficial, but I had it for maybe 5 hours and every second was torture.

 

Me and the seller exchanged only three messages, two from me and one from them.

Me, terse because it's 1 am: I don't want this, it had gunk on it, it functions I guess but it's not for me, will be returned in nice conditions

Them: I don't understand why you need to return it? Do you have pictures of the damage?

Me: No, sorry, I didn't take pictures. I'm sorry for being terse in my last picture, but I just don't want this anymore. Please take it back, it's already packed up.

Next thing I knew, return request was closed.

 

Thanks for sticking with me so long through that story! I'm a bit of a long-winded person, but I tried to cut it down. What do I do now? I waited a few days to come back to thinking about this issue because the day that happened was just an all-around bad day, and I had to deal with other things. If I get my money back, it'll only be ~100 bucks - but I'm a college student, so 100 bucks is important to me. Would it make more sense to file a claim, or just like, re-sell it? This was all totally my mistake, I just want this situation over with as easily as possible...

You lost your buyer protection when you opened the keyboard.

When there is a problem with an item, go to the resolution center below and select, the item doesn't match the description.

Seller would have to provide return shipping and refund you once the item was returned.

I am assuming that your purchase is this listing.  Generally speaking, the item appears to have been delivered to you in the condition described, and the seller does not accept returns.  (Things like scratches and dirt/grime are consistent with used equipment).

 

You requested to return it, and the return request was denied.  Thus, there is no additional claim to file on eBay.

 

However, your confusion about the model could be something you can use in a claim with PayPal.  The seller lists the item as model 9PY-00001, which is a Surface Pro 4.  If you did not get this model, then you can return it as Not  As Described through PayPal.

^^^^^^^^^^^^^^^^^^^ This.  You ordered from a listing that offered a Surface Pro 4, you received a Surface Pro 1.  Go through paypal.  You will have to pay the return shipping, but Paypal may reimbursh that since it's a NAD claim.

I see! Thank you, dtexley and orangehound, I didn't catch that. Gosh, there are so many different Microsoft Surface products it's hard to keep track of them.

Okay, I'll go see how to do that through Paypal, but if something else eBay-related comes up, I'll be back. And if anyone else has any advice, I'll gladly take it.

I think you can still file a Not As Described case with eBay.  You haven't used buyer protection on eBay, so you don't need to go to PayPal.  With eBay, you won't have to pay return shipping for an item that was not as described. 

 

The seller was able to deny your request because he listed it as no returns, but that does not apply when an item is not as described.

I'm pretty sure a buyer can only file for one return request per item ... since the OP was turned down for a remorse return, he is not eligible to file another return for SNAD.  This is why he needs to go to PayPal.

About a year and a half ago I had a buyer who filed a remorse return.  He sent the item back and I refunded.  Then, he decided that he wanted the shipping refunded, too, so he opened a Not As Described case for the item.  It was definitely possible at that time, although I know that eBay policies are subject to change.

Sounds like the buyer found a Customer Service Rep to manually override the system ... eBay has taken away a lot of power from CSRs over the last year or so, mainly because they did maddening things like you described.
