I hope this message finds you well. I recently made a purchase on eBay for a pair of shoes . Unfortunately, when the package arrived, it was an empty envelope, and the shoes were missing.
If anyone has experienced a similar issue or has advice on how to proceed in such a situation, I would be grateful for your insights.
I need to proceed to get a refund if someone can help me .

You have to file the right case. You must file an item not as described case. Since you did receive the package. Go to purchases and click the return this item button. Then choose not as described.

I don;t think that's the best idea. If the seller says, return the shoes, what will the buyer do? Send an empty box?

Yes that is exactly what he does. That is the right case to file.

Does it seem that the package was opened and the shoes were stolen? What is the weight on the shipping label? I would visit the post office and ask the local postmaster for advice. If it was stolen, you should ask them to open a case to investigate the issue.
What did the seller say? Of course, one would expect they would say they did send the shoes, but from their response you may perhaps feel, if they are telling the truth. If the postmaster agrees to further investigate, you may want the seller know that there will be an investigation and ask them for future cooperation.
Hard to give you a more detailed advice when you have not provided any details. Hopefully, you have not filed the case yet (see my comments to other post). You need to start with stating the facts, because then you lose your credibility.

This is an "Item Not As Described" case all day long. Don't waste time with the seller, don't bother with an investigation, don't do anything else but file that claim. You are limited to 30 days from the EDD to do so. Too many people waste time and then lose their money before realizing it.
I've never bought shoes that come in an envelope. It sounds a whole lot like you were intentionally sent an empty envelope with tracking to cause you to file an INR ( which would be the wrong claim) and lose your money.

Did the "empty envelope" you received have stamped markings that state that it was received empty? Whenever an item is ripped, open or damaged, USPS marks it.
As I told another poster with a similar complaint this afternoon, if it was delivered and unmarked, it's likely that if it's now empty, it was stolen after delivery and not the seller's fault.
Buyers need to have a secure place to receive mail and if it's apt to be stolen, they need to rent a p.o. box.
Speak to your carrier or postmaster and have them verify whether the package was empty at the time of delivery. It may be a police matter as well as federal crime if someone is rifling mailboxes after delivery.

@martin2001 , The advice your giving is wrong. He should do as advised file an item not as described. Let the seller take care of the investigation if there is one. Why would you ask the buyer to do that?

Save the investigation until after the refund comes. That way, when nothing turns up ( and nothing will... There will be little attention paid to this case) at least you will have been made whole.

I would make sure to take pictures of that envelope with the address label so anyone can tell it is not a pare of shoes.
