How long after estimated delivery date can I file a claim

Since Ebay seems quite convoluted, I was hoping for some community help. I purchased an item on 5/23. The label was created 5/25 but the item was never actually shipped. I tried to open up a claim at 1:00am 6/9 but theres no option. Is there a waiting period after the est date? I also learned that I'm not the only one. Seller seems to have become a scam account... Hoping to get my money back.

Per eBay protocol, you can open an item not received case 24 hours after that and have 30 days to do so.
