Kind of unsure how to procede. I ordered a Cell Phone from a good seller, And after a "Delayed" stay in Chicago, My empty/ripped open envelope was FedEX delivered on my door step this morning. The delivery person even bent the envelope in half, It was obviously open.
FedEX marked the package as Delivered.
I contacted FedEX and filed a claim with all the pictures & Contacted the Seller to possibly report the phone stolen as well.
Buyers response was they have also filed the claim with FedEX and "Unfortunately we cannot file a police report as it was your personal package that was stolen. I would suggest opening a case with eBay.

I am unable to fine ANY WAY to contact Eay about it, and Paypal referes me to Ebay as the "package" was marked delivered. Still havent heard from the claim I filed with FedEX, but i have the case bumber. Is there ANY thing else i should be doing? The istructions are clear if the package is lost or stolen BEFORE delivery, but none if an empty/open package is marked Delivered.

An item not received complaint will NOT work, as you did receive something - the empty, damaged envelope.
Open a return for missing parts/pieces. The seller can either refund in full or send you a return label. If he sends the return label, return the empty envelope and get your refund. The seller can pursue any claim with Fedex.
No, it is not the seller's FAULT that the package was delivered empty, but it IS his responsibility.

Thank you. I did talk to Ebay today, and they started the return for me. Buyer sent me the return lable. I am SO MAD at the FedEX driver for putting an obviously open bag on my porch. You can see the outline of where the box was on the outside of the bag.
Sad because the seller did nothing wrong, and neither did I.
Thank you for the input. FedEX has not responded to me, so i assume since the seller paid the insurance it is his responsibility to file the claim.

The driver had no choice but to deliver the package as it was but I am surprised that it was not marked "opened' or contents missing." Please safe the package. The seller might need for his insurance claim. Please help him by filling out any forms that he sends you when he files the claim. As someone stated, you open an item not described claim. Follow the prompts. The sellers has a short time limit to refund. He has to open up the insurance claim.
Is that driver the same one everyday? I am just wondering again why the package wasn't marked as opened or contents missing or destroyed in the process. Makes the driver look suspicious. I find it hard to believe that the package was put like that on a truck.

It’s highly unusual for FedEx to deliver a package in that condition.

I received a box from Japan via FedEx today that was supposed to contain a used watch, but it was empty and had been resealed. Not sure how to proceed yet, but the watch was NOT cheap and is not a common piece. Hopefully, it was weighed along the way so they can determine where in the chain the thief is working, but I'm not sure anyone cares.........

You'd have to file a return request for missing parts or pieces @sfbullit .
However I'd contact the seller first as they may be willing to work with you first. Send them photos. Just don't let it drag out - you have a 30 day protections window for filing a missing pieces return.
