Concern about locked case

I recieved an item not matching description. The seller elevated my case to ebay claiming I hadn't responded nor posted any pictures of the item; this because he'd told me in his first post that I had to send the pictures to his email address which I had been doing all along. Now I can no longer post anything to the case page as it's been locked and is going to be reviewed by ebay and it makes me seem like the malicious person, as to ebay it will seem like I've made an empty claim without any evidence to show since I sent all pictures to him directly as he requested. Is there any way to add pictures 'post-elevation', or do I have to appeal to the case (I previously read you can do that here on the community), in the event that ebay rules in the sellers favor and I won't see my money again?

The backstory if you love reading:

I ordered a gtx 1060 gpu from a spanish seller. Upon opening the correctly labeled box containing the gpu I was disappointed to notice I'd gotten a gtx 1050ti with tampered 1060 stickers on it instead. I filed a compaint and a case was opened. The seller replied in spanish and I had to use my google translating skills to understand what he wrote. I understood that I needed to send pictures of the card to his email address, and I did. A few days later I recieved another message on the case page from the seller that I needed to send additional pictures which I did, this time with the gpu installed in my computer and an image from a program on my pc confirming the card's true identity as I figured that's what he wanted. I later get a third message that I need to upload the pictures to ebay, but I was sick and tired so I ignored it and decided I'll wait until tomorrow when I'd able to contact ebay to help me find a solution. Next thing I know the seller himself has done the same thing I planned on doing. If he'd only said he hadn't recieved any pictures I would've uploaded them on the page right there on the spot.

Sellers can't demand pictures like that. It has no bearing on the case at all. You should only send pics to eBay if they (eBay) ask for them. Most likely eBay will find in your favor.

 

Once you start a case do not contact the seller through messages or email. Use only the case to interact with the seller.

 

A case should go like this:

1) open return request, not as described. Keep comments short.

2) if the seller does not accept return, escalate to a case

3) return item using label provided.

 

There is no need to go around and around with the seller. They are just trying to string you along until the case runs out.
