believe its 4 or 5 should say next to the item in sold listing awaiting payments , what date you can cancel for non payment.

You can cancel for non-payment as soon as 96 hours and one second after the sale.
Edit to add: Don't send invoices (eBay sends payment reminders) as those reset the buyer's payment window.

You can cancel 96 hours from date of sale, unless you've been sending invoices. If you are sending invoices then the sale date resets to the day you sent the invoice.

Unless you listed with immediate payment required, the buyer has 4 days to pay. The seller can cancel on day #5, citing "buyer did not pay" as the reason.

It's better to send a polite reminder to the buyer instead of cancelling (unless it is an item you are sure will sell quickly after you relist). I usually send a reminder after 5 days and wait another 5, then cancel. Sometimes, people will buy an additional item after the reminder. Sometimes they really forget. With the current state of the economy, one should appreciate every single sale and not give it up easily.

You're extremely patient! Most sellers cancel after the minimum of 4 days; many have even opted to do it automatically. I wonder what percent of your late payers eventually pay up on day 5 or later.
Here is the Help page about what to do if a buyer doesn't pay:

By the rule of Ebay not me, you have to wait 96 hours after auction listing has ended. Then it is your choice you can cancel the sale stating buyer did not pay and this will give the buyer a strike and the buyer will not be able to leave negative feedback for you and you can block the bidder from ever bidding on your items again. Just don't send another invoice, because it resets the clock for the buyer.
Me personally after auction ends eBay sends and invoice, and I send one. At this point if they don't pay by the stated time frame within eBay rules as state above, I report the bidder to eBay, and block the bidder from my future auctions or listings.
4 days is more than enough to pay in fact in my view you should pay right after winning an auction but i don't own eBay . I personally don't send a friendly reminder at any point because 1. some buyers will claim harassment 2. The buyer know they have won the auction because eBay sends and invoice automatically and so do I immediately after auction has ended.
Hope this helps.
