so I sold a printer recently where the listing said the printer needed a new printhead. the buyer bought it claimed I know how to clean printheads why would I buy a new one. So they didn't buy a new print head for it and now opened not as described dispute and wants me to pay for shipping to and back out of my pocket. my listing says doesn't accept returns. I offered a compromise that if they pay for shipping back i will refund them they don't want that. so I offered to give a partial refund for a new print head of 15, new one cost about 20-25 they declined.   In my listing I listed in caps to 'READ THE DESCRIPTION' that it needed a new print head. For their mistake I will be out like 40 dollars in shipping, how would that be fair? I'm waiting the X amount of days so i can escalate the case I also reported the buyer. So would ebay side with me or am I SOL?

If you wait, you will be SOL for sure. Remember that No Returns does NOT mean no refunds when the buyer opens a NAD case. EBay will give the buyer a full refund and let them keep the printer if you don't respond. You must decide if you want the printer back or not.

I also forgot to mention, that if you let eBay step in and close the case, you'll get a defect and lose you fees. The time to appeal is after the case is closed.

Buyers sometimes ship by picture and price and ignore titles and hardly ever read descriptions. There for it maybe an idea next time you sell one like this to contact the buyer before shipping and make sure they read the fine print of what maybe not included. ebay will likely side with the buyer in this case. No returns doesn't mean anything these days they can still open a charge back with their bank and would get the full money back. You'd be better off having 30 days returns buyer pays return shipping. That is enough to put off many buyers asking for a return. On that note if you have your policy 30 days returns buyer pays return shipping and buyer opens INR you can then call ebay and say it is as described, you'd have a better chance then of ebay siding with you.

Either send the a return label, get the printer back, and then refund in full .....or.....let eBay take the money from your account to refund, and let him keep the printer.  On the latter you will also get a HUGE defect on your account that could possibly block you from ever selling again. 

 

There is NO such thing as not allowing a return for "Not As Described" and the buyer can lie through their teeth and still win the dispute.  You are right it is not fair, but it is the way of eBay.

But what if the buyer then provides tracking for that INR showing unauthorized?

If you escalate the case, eBay will side with the buyer. At this stage, eBay will nearly always find for the buyer—its automatic. If you feel you have a strong case in your favor, once the matter is finalized, you can appeal. This is where a human will review the documents you submit. Keep in mind that Ebay is a buyer-centric platform. Below is the policy pages with info on how to appeal. Good luck.

FWIW, the few electronics I list I choose "for parts or not working" for the condition.  That way when they claim "doesn't work" ... well thats what you said in the listing. 

I don't think it stops a NAD but it slows them down a little.

If you push the issue, you will be SOL.

 

I would work it out with the buyer and offer to refund him enough to cover a new print head.

 

If that doesn't work, accept the return. Refund his money when you get the item back.

 

Re-list the item .  This time do a better job of "idiot proofing". You have to make it so that a 3rd grader will understand that it needs a new print head.  Bold letters.  Red font. Repeat it 3 or 4 times. Put it in the TITLE and the DESCRIPTION.

You can say it doesn't work.

 

Even if it miraculously works, the buyer can file a not as described case and win.
