recently we have sold a product to a European customer. Item was genuine brand new car part (carpet), we have sold many of this already without any complaints.
After a while buyer opened a case "not as described" and claimed, item does not match his car, however, it's in the description.
we asked a buyer for some details, car type, VIN, etc, no answer.
we have accepted the return, however, buyer did not sent the item back, nor has answered any messages.
we contacted ebay - maybe it was a mistake - now it seems, that the buyer do not have to return the item, if we need it, we should pay the return cost and manage return, but either way we must give full refund to him.
So basically, if I buy sg. on ebay DE/FR, after receiving I click on "item not as described" and I can keep the item and wait for the seller to refund it? is it okay?
anyone having experience with EU laws or ebay EU sellings can give me some advise.

That's a major flaw in the system. All a buyer has to do is claim not as described and the seller has to prove it WAS as described or at the very least pay for the return. But on the plus side, the buyer has I think 5 days to ship the item and if they don't, you can call customer service and get the return closed in your favor. I think that's how it works, if I'm wrong I'm sure someone will correct me.
If the buyer is just looking for a quick refund do they can have the item for free with free shipping, it's doubtful they will respond
