Hello i need to know what I need to do. I sold an item it was a belt the buyer kept it for a week and then stated it was not real. I never stated it was real but he wanted his money back and you gave it to him plus shipping. When the belt was returned a week later it was damaged. The bett buckel was removed from the belt and now it will not stay on. the buyer removed it and broke when doing so. I would like to have a claim for the broken belt.   I would like at least half the price of the belt. Please let me know what I can do!      I attempted to contact the buyer but he refused to make good the damage.     thank you

This is the community board, you are not actually talking to anyone who works for eBay. 

 

There isn't anything you can do. I supposed you could attempt an appeal on the case, but it is 99.99999 likely that you will not accomplish your goals. In the listing you stated that you did not know if it was authentic or not, so the buyer shouldn't have taken a chance.

 

You now have two negatives claiming that you sold a fake belt, which isn't good.

If you sell a belt or anything marked as Louis Vuitton and it was not made by that manufacturer then you are selling a counterfeit. You are not allowed to sell counterfeits...period. 

 

You must have known it was a counterfeit since you do not mention the name in the title, but it is included clearly and repetitively in your photos which are a part of your listing.

 

You will not be compensated for any damages and you may find your account compromised if you pursue selling counterfeits

Here's a novel idea - How about you STOP peddling counterfeits? BOOM, problem solved! Although technically speaking I don't think you're going to need to worry about dealing with returns on ebay for much longer anyway.

 

And as a super cool bonus, if you stop peddling (and buying) counterfeits then you will also stop associating your name with,  and supporting all the evil and ugliness that goes on behind the criminal world of counterfeiting. You know, like the 911 terrorist attacks? Yeah, that type of stuff is usually at least partially funded by the sales of illegal counterfeits. 

 

As far as the buyer returning a broken counterfeit belt, well........I'd normally suggest that you file a police report and mail fraud report BUT...........you sold an illegal item, lol. No court of law will help you when your own hands are dirty. You should probably just be happy knowing that you haven't received a Cease and Desist Letter, or lawsuit from LV.

Ebay does not compensate sellers in this situation. Consider it a business loss. You sold a counterfeit belt. That is a big no-no. Faulty returns, according to eBay, are the cost of doing business. Now the buyer shouldn't have damaged the belt but it is what is.

It's interesting how eBay picks and chooses what counterfeits they go after and take down meanwhile this seller and sellers from China carry on by peddling their fake wares.  I came across a listing the other day from China that I am 99.9% certain is fake baby GAP.

 

First the chest logo isn't quite right and is missing the word "baby" which should be in small cursive writing in the center of the logo, also the only baby GAP hooded rompers like this I have ever seen have snaps inside the legs for any easy diaper change.

 

This seller has terrible feedback.  All seems to point to fakes.  And I'd bet the quality of fabric they use is terrible and itches poor little baby.

 

See item # 332018752956 and let me know your thoughts.  I haven't reported them because I quite simply can not say with 100% certainty that they are fake.

China = Counterfeit capitol of the WORLD

 

That seller is peddling counterfeits. Notice how they choose "unbranded" in the item specifics though? Yup, they are trying to fly under the radar. AVOID. 

 

The very first thing I do when searching for something on ebay is check the US ONLY box. It doesn't get rid of every sneaky seller from China but it cuts having to sift through their counterfeit and/or junk a lot.

@itz_stacey  Wow Stacey didn't even notice that unbranded in the item specifics. What a total fraud.  Advertising it as babyGAP when it's nothing but a knock off. It has "GAP" written all over the title and description and on the clothing! Why and how does eBay let this shifty character get away with this?
