I sell cosmetics that are AUTHENTIC and "inspired by" brand names. That is, these cosmetics do not claim to be replicas of other brands but they are a cheaper version of other brands. Even though I don't have to, I mention clearly that "This (item name here) is not associated with the brand name (brand name here)" I have sold hundreds of such cosmetics.
Some of my buyers fail to read item title and descriptions and initiate return requests claiming item is inauthentic or "item not as described." I accept the returns to avoid the hassle of calling eBay to file for a wrong return request.

To be clear. I think it is perfectly acceptable to advertise a product and state that it is NOT authentic. That it is.. say, a generic... that it fills the original OEM requirements...
to me, this is Okay.

I'm sure some of your buyer know exactly what they are getting and are ok with that but clearly a bunch of your buyers are fooled as the manufacturer intended.
These buyers feel ripped off and for many of them they might never buy on eBay again and tell their friends "yeah eBay, full of knockoffs and other **bleep**....don't waste you time".

Ebay not only feels that it is good for them, but they feel it is necessary for them to survive or they would have gotten rid of these issues a long time ago. Instead they help the Chinese to steal and rip off the American public with all of these fakes and reproductions. The CEO has admitted multiple times to sending the Chinese the information they need to manufacture these fakes so that Ebay would always have the hottest items available for sale.
Ebay also changed the UA to read that they have the permission to use or sell any IP that is listed on their site. So for a 30 cent listing fee, Ebay has taken the rights to any and all Intellectual Property, even if the person that listed it did not have the right to list that item. This allows them to profit by selling this information to their Chinese partners who they still do continue to sign partnerships with for the faster production and shipping of these reproductions or to anybody else, even your competitors, all for 30 cents. Now tell me that Ebay is not condoning all of these fakes and counterfeits being sold on their site.
This article below shows that Wenig has had this plan with the Chinese for years and that he actively paticipated and still participates in Ebay having all of this counterfeit stuff for sale. Ebay also refuses to stop the constant duplication of listings by their Chinese partners and for a Technology company sure seem to do a very poor job of blocking the Chinese junk from showing up in almost every search, even when a buyer checks the box to only include US goods. I am sure part of their contract with the Chinese calls for this to happen because it benefits the Chinese, especially right now while the United Nations has given them 3rd world country status for all Postage rates world wide. So they pay the same amount for postage to us as somebody in Gabon would. Now tell me they are not helping the Chinese take advantage of being one of the top countries in counterfeiting items and allowing them to be sold on Ebay.
Ebay knows they will show negative growth without all of these knockoffs and counterfeits being sold on their site and really could care less if that chases off a buyer down the road. They say one thing to one group of people and then the complete opposite to the next set of people depending on what they want to hear. Ebay has no clue about how to grow a business any longer as they have only space to rent and they continue to chase off those that rent it and those that would buy from a company renting that space, which is starting to make that space less and less valuable. This is what Sellers are all beginning to realize, Ebays space rental is not as good a deal as many other sites continue to pop up and Ebay continues to allow their buyers to be ripped off by their Chinese partners and not want to come back and buy from Ebay unless their is no other choice.

We Are also upset WITH THE NEW REGULATION
PLEASE READ WHAT WE SEND TO EBAT AFTER 15 YEARS COOPERATION
We are very disappointed from the new regulations regarding " not as described items " and the strict limits you applied .
We are sellers for Health & Beauty items which is a very sensitive category with a lot of returns.
We are ebay sellers for more than 15 years and our statistics saw the following
About 1.6 % of the sales are fraud claims for not as described items
About 0.7% of the sales , are claims for products which are used or opened
About 0.8 % of the returns are damaged from transportation . You know well that any good package can be damaged dew to bad handling especially shipped overseas
You act like you dont know they are fraud buyers which you also protect and encourage now
You also know that we can not open the original sealed packing of the product to check as the product will be considered used
Unfortunately you dont care for the sellers . All these new regulations have result to stop cooperating with ebay due to high selling fees and not fair rules .
Soon you will run out of serious sellers who do not want to sell with such risk and with such high selling fees
We are really very much disappointed after so many years long standing cooperation

Here is an ebay designed designation: "Ranting on this forum cannot change the fact substandard sellers pay 4% more". Sent by an ebay employee. I have reviewed the new label for substandard and also reviewed my own return rate and realize the substandard label is specifically designed to raise ebay fees, not educate and assist sellers in resolving a selling problem. That is obvious when you group simple questions about items, items returned due to not wanting it, finding the missing item you opened a "Not as Described" case for in the box after you opened the case, opening Not as described cases due to an item being the wrong size, not allowing anyway to have a not as described ding on your account removed (they are permanent, correct or not, they cannot be removed). And in general using the system that was formally used for cooperative communication between buyer and seller as a weapon against the seller, forcing the seller to create avenues of communication that circumvent this new minefield. This change has destroyed a means of improving our selling system and turned it into something to be hated and loathed by all sellers. The new system has absolutely no place among the vast number of sellers that sell used items. It is designed to fit sellers selling new in box merchandise and absolutely devastate everyone else. Why does ebay hate sellers of used items so much? I sell about $60,000 worth of items per month to everyone anywhere on ebay. The new return rate fee increase is completely impossible to get around, it hammers all low volume sellers, raises my ebay fees from $5000 per month to over $7000 per month and worst of all for ebay, causes sellers like me (as of next week) to port all of my ads to Bonanza and Ebid (porting allows all active auctions to be transferred at once to any of these selling sites, ebid and bonanza charge 3% selling fees, no listing fees). It will be more work to have them running on multiple sites at once, but that is the only option ebay is providing me to keep my fees from ruining my business (by lowering the amount sold in ebay). So explain to me, Ebay, understanding that the upcoming new rendition of "substandard" yields the results above while also strengthening the competition, weakening customer loyalty and lowering influx of new sellers, how on earth did anyone in authority in Ebay approve such a mindlessly narrow minded, short sighted and infuriatingly insenstive "substandard" new policy? If (ebay person responding to this message), you are going to reference my return rate of 3.7%, (ebay user id adickson) and lecture me about, then take a good hard look at how that return rate was determined, so many things that have no right to be there are used to inflate that rate for the desired (by ebay) fee increase. I have survived on ebay for 18 years not by following rules that are impossible to follow, but by finding the best ways around them, then helping all of ebay sellers I know work around a new problem once I have figured out how to do so. I also could have listed another $500 on ebay in the time it took to write this message, thank you ebay.
