When the item received by the buyer doesn't match the listing

A buyer is covered when they open an eBay Money Back Guarantee refund. They may not be required to ship the item back to the seller if one of the statements on the left side of the section are true. The seller would need to refund but could not require the item to be shipped back.

Shipping counterfeit goods is against the law therefor eBay may not require a buyer to break the law to ship a counterfeit item. Carriers have strict requirements about hazardous shipments and may not allow them. For example a broken glass item, you can not ship a box of glass shards. Same for dead fish, expired food, etc.

Some sellers, for whatever reason (too expensive to pay return shipping, cheap item, too much hassle, etc), do not want the item back. In this case you keep the item and get your money back but either way, you have to at least initiate a return request.

The red only pertains to the conditions to the left.

You correctly described the situation that is indicated in the product return policy on eBay...... And I also understood the same as you...... however, these rules, unfortunately, are not respected......

It is all understood by the word "may".

If it said "will not" then it would mean "will not".

As it says "may not", ....................... then it is "may" or "may  not".
