Tracking has customer package stuck in limbo since "label created" and "on the way, delay" for several weeks. Who is supposed to file the claim, the seller or the buyer? The buyer says I am supposed to but need to be sure. TIA.

It's best begun by the shipper. They have all the relevant package details etc. Hopefully your parcel umm doesn't have legs, and knew how to use them? Most likely caught up in the mess we refer to as the Xmas overload!!

Hi you have to do it, and if its damage technically they send it back to you then you file a claim with whoever was the delivery service. However I had a case of a broken lamp by UPS where I asked the buyer to hold it just send me photo's of the damage. (cost about 40 bucks to ship it) I then asked UPS to pick it up if they needed to at the persons house to inspect. This turned out to be a nightmare The buyer was so uncooperative and obtuse after one day of them not coming. I ended up finding out that she intentionally damaged the Lamp to get a refund because she didn't read the listing and we sent out the shade in sperate box. She thought we only sent her the lamp so got mad and damaged it. I caught her in a lie but UPS did give me my money back eventually but took a month. Hope this helps a bit. Merry Christmas

You should as ebay holds you liable to your buyer.
You will need to refund the buyer in full if the item is not delivered.

Odds are UPS lost it and is stalling. File a loss claim and you may get some action.
