I recently sold my 4 month old MoFi UltraDeck Turntable for $1,440 + shipping. It was packed back in the original factory box and packing and than that box was packed inside the original outter packing box. My buyer received it and it was damaged. There were signs the box had been dropped or snagged on something by FedEx.
I've filed a claim with FedEx as I had insurance on the shippment...once I get my insurance payment from FedEx, I will refund the buyer...but my question is, let's say this takes a couple of weeks to resolve, can ebay force me to refund the buyers money even though I have no control over FedEx? Why am I liable for FedEx when I can't regulate their business in the first place?
What programs does ebay have to help me, the seller should this matter go south and I have issues with the claim from FedEx? Are there programs to offer a one-time payment to me for this loss?

Simple answer is yes.

If you try to hold up the refund until you receive compensation from FedEx (if they even pay off) it will not go well for you as far as eBay is concerned. Your buyer won't wait, they will ask eBay to step in and force an immediate refund and eBay will give you an unresolved by seller defect (the absolute worst kind of seller performance defect).
The insurance from FedEx is for YOU not for the buyer.
Be warned FedEx just love to deny damage claims due to "improper packaging", you might prevail on appeal or you might not but that is not the concern of the buyer.

Insurance is your protection. You need to refund the buyer now because they are owed and entitled to a refund whether your fedex claim is approved or not. eBay can and will force you to refund and no they don’t have any programs to cover your loss if an insurance claim is denied.

Thanks for the respons...I feel bad for my buyer...but I'm really PO'd at FedEx and fear the claims process will be a PITA. I thought about just refunding the buyer now and seeing what happens with FedEx...but I can't afford to lose my $1,440 payment... Conflicted about what to do here???

eBay will attempt to debt your Paypal account for the refunded amount, and if that amount is not their, eBay may put a temporary freeze on your selling privileges, and Paypal will freeze any incoming payments to your account, and give it to eBay.
You can try to fight the buyer claim if they fail to cooperate with a FedEx claim investigation, though you need to provide proof from in writing/email from FedEx.

Well, it wasn't improper packing as it was the original 4 month old packing from the Mfg...and I did buy insurance. I did speak to ebay and they advised that they are putting the case on hold to allow FedEx time to investigate. This seems bad that I am being held liable for FedEx. Buyers get a one-time payment for lost shippments but sellers don't get any help?

You can wait it out until eBay pushes you to do a refund, via a notification, and then contact eBay, and tell them you have insurance, and are waiting for a FedEx claim to be processed, and request a delay on their end. It's worked for me in the past with a USPS claim. Worth a try. You have nothing farther to lose.

Oh no, they buyer is not being difficult at all. They are coorporating and being very helpfull with the process. However, I just hate the fact that I am helpd liable for a company which I cannot control.

You need to refund the buyer now and hope FedEx pays off.

That's one of the drawbacks with having to rely on others to handle your shipments, and eBay's buyer, MBG. Though I rarely get a USPS claim, I hate going through the process.

First, I want to say I'm truly sorry this happened to you, esp since it's a very large dollar amount.
But second, I want to flip this around, sort of. If/when you purchased this item, if you purchased it from say Best Buy (or another major retailer), and had it shipped to you, Best Buy would be using UPS or FedEx or USPS to ship it to you. If it arrived damaged to you, from the shipper, would you be willing to wait a few weeks for either a refund, or a replacement item sent to you?
I know I wouldn't. A larger retailer takes the same risks we do, when shipping items out. Granted, they have a better 'buffer' for errors, but a major retailer wouldn't ask nor require a buyer to wait a few weeks for either their money back or a replacement to be shipped. Is it fair to ask the buyer to wait for either their money or a replacement, simply because the business/person selling the item isn't as well funded?
Like I said, truly not trying to be cruel or cold, just pointing out that major retailers use the same shipping companies, and are held to the same standards that eBay will likely expect of you.

Sorry, OP, but the matter of insurance is between you and the carrier and does not involve the buyer. You will need to refund the buyer. The buyer does not wait until the insurance claim is decided.

Because you hired Fedex to deliver it for you.
Can eBay force you to refund?
Yes - those were the terms you agreed to when you chose to sell here.
Will eBay reimburse you $1440 if Fedex denies the insurance claim?
No. If eBay started offering one-time $1440 payments to cover seller losses, every seller would suddenly encounter a one-time $1440 loss.
What is the sellers liability?
In this case, $1440 plus shipping.
