Vero violation question?

Received the following from Ebay:

Hello liawrig.nq8rdwqa3,
Your account has been restricted because activity on it didn't follow our VeRO Unauthorized Listing Policy. Copying pictures, text, or other copyrighted materials without the rights owner’s permission, is not allowed. ...

What you need to do next

You should always create your own content for use in your listing. If you use content from another source, you need to have their permission to use their content before creating a listing.

What is the policy

- Your listing was reported by MyPillow, Inc. for using their copyrighted materials without their permission. eBay’s Verified Rights Owner (VeRO) program 

Because you haven't followed this policy in the past:
 - Listings that don't follow this policy have been ended.  (which ones besides MyPillow)
- A temporary 3-day selling restriction has been placed on your account (starting on the date of this notice), and your other listings will be hidden from search during this period.

Are they saying YOU a potential buyer cannot see my listings for 3 days (6/8)? Or just that they removed that one listing?

I can see (and open) 122 listings for you, and when I did a search on one of your titles, it did come up..

Which ones besides MyPillow? The answer is right there: "Listings that don't follow this policy . . . "

 

So, apparently this wasn't your first warning? You've been warned by eBay about this before? You've got one foot on a banana peel, as they say.

At the moment, your listings can be seen, and may  be able to be purchased- but the 3 day is coming and that will not be the case, as well as not be able to add any new listings during that suspension.

 

You need to check all your listings to be sure you do not have the same issues, because if you do, the next Vero action will be longer than 3 days, and a 3rd time you could lose all selling privilege's.

Pburn, yes, this is my 2nd warning.  I DID NOT KNOW.  I was able to list Mypillow on another site.  I didn't know it was a VERO.

It would seem that EB would have a way to immediately warn you that the brand is VERO when you're listing.  Just my thoughts.

I have 4 bids, they won't stop the bids will they?

Your first warning would have told you not to do it again.  Since you did it again you got in trouble again.  So in an effort for them to get you to pay attention to their warnings, your account got restricted for a few days.  That means you can't list any new items.

 

Do it again and the restriction will be much longer.  And if you continue the pattern of ignoring their warnings you will lose your selling privileges completely.

 

You need to pay close attention to these emails and take what they say seriously.

 

You may run into this same problem with your Purse listing for the Buxton wallet.  You are using a pic that belongs to Buxton on that listing.  If you do not have their permission to use it, I'd get it off there before you get dinged again.

 

If you have any other listings like this.  I suggest you get them corrected.  Only use pics that are yours or you have permission to use.  That way you won't have this problem again.

The use of copyright protected material without the copyright owner's written permission for commercial purposes is a good way to find yourself in court for infringement.  If the copyright is registered the copyright owner could sue for not only actual damages but punitive damages as well.  US Copyright Office

 

The VERO program is designed primarily to keep eBay from getting drug into litigation by the infringement of a seller.  It is usually unwise to relist something that has been taken down for a VERO complaint by the rights owner until one has followed the procedure and worked things out with the rights owner.  Continued violations could easily get one permanently banned from the site as well as resulting in litigation as mentioned in my first paragraph.

You are not in trouble for listing the MyPillow, you are in trouble for using their images and/or text in your listing instead of your own. You violated their intellectual property by borrowing something from their website or other content for use in your listing.

Everyone -- I did a search of My Pillow Small Dog Bed, and there are about 4-5 up.  They don't use the stock photos and they describe it in their words.  But IT'S STILL MY PILLOW.  So what way are we to list MY Pillow dog beds?  There have been several sold in May.  What are those sellers doing that I'm not doing.

You are supposed to take your own photos and use your own text. Obviously from looking at your listings you don't do that. As a buyer I see that and my mind says "dropshipper or lazy seller, let's go elsewhere"

VeRO is a system that protects copyright and trademarks from abuse.  You can sell items produced by VeRO members as long as you follow the rules. The items must be genuine, and you must use your own images and text.  

 

The main purpose of VeRO is to prevent abuse of trademarks such as selling counterfeits or using the word "like" and a brand name in a listing for an item that isn't really that brand name. Or using a brand name to describe an item that might not be that actual brand; Velcro is a very common example of this situation.

 

VeRO is just an enforcement tool for the legal rights that are attached to any copyright or trademark. It's not a special club of companies that have special privileges. So in that sense you have to just act as if EVERY company is a VeRO member.
