USPS worker caught with the item, should I proceed with further actions?

Found evidence that Buyer abused USPS position to ... - The eBay Community - Previous thread

 

So OIG agent caught the buyer/USPS worker with the item he purchased off me roughly 2 months ago. The Agent contacted me yesterday telling me he confronted the buyer at his home and he didn't resist. The item was confiscated and the USPS worker will be removed from his "post" (I assume he's just going to be a regular mail carrier again.)  He also told me it's not worth prosecuting bc the cost of doing so for such a case isn't worthwhile. What should I do? The buyer literally scammed me, and wasted my time and money. Now all I get is a used item returned to me. (not even sure if it's damaged or not)

 

Is it worth filing to a Small Claims Court? (I'm in NY, he's in TX)

Not worth pursuing as you would have to file a small claims case in Texas.

How is this small claims related if it's clearly a criminal matter. Isn't postal theft a federal crime?

 

Small claims is for civil disputes, not a mail carrier literally stealing packages.

The item was confiscated and the USPS worker will be removed from his "post" (I assume he's just going to be a regular mail carrier again.

 

Not good enough, he should be prosecuted as said above Mail Theft is a crime, I would be going to the media because USPS will sweep it under the carpet

You would also have to file the criminal complaint in TX as well. That is where the crime occurred. I would ask the PO why they are not filing charges and is there anyway for you to do so.

Something about this does not sound right. It was worth it to have the OIG investigate and confront this guy at home. Then the agent's next step is to talk you out of pursuing criminal charges? Chances are if this guy stole your package he is stealing others too. Are you sure the person you are talking to is an OIG agent?

Ya that's why I am confused. I literally provided ALL of the evidence for them to just visit his home and confiscate the item. I am pretty sure he's an OIG agent since he's given me details I haven't shown anyone aside from the OIG department.

I feel the same, that is why I filed the case with OIG. If I didn't want the trouble I would've just claimed my insurance claim money (I still haven't gotten that yet btw). I just don't want to put the Agent on blast since he's been pretty helpful with this but telling me to not prosecute is just odd.
