I never received payment for an item I had listed. I had contacted the buyer and they promised to pay, so I did not open an unpaid item case. I shelved the item, forgot about it. Now I am on day 33 since the item sold and I decided it was time to open a case. Perfect timing, right? Now that I have passed the 32-day deadline I can't open a case but I also can't cancel the order either. It's sitting there in my "awaiting payment" category but I can't take any action it. I would like to re-list the item but would prefer to have this older order resolved first. What should I do?

For an unpaid item, the buyer has the option to pay for 36 days after the transaction. That's why the deadline for filing an unpaid item claim is 32 days.
Since the OP is on day 33, it's just too late for him to do anything. Nevertheless, he should wait 3 more days to be absolutely sure that the buyer won't pay.

File a case before 30 days are up.
Seriously, while you can't get your fees back now, I think since it is after thirty days, you can just relist.
Hopefully others will weigh in on this as well, to confirm or deny.
