Switcharoo defect removal.

Sold a charger for a kids ride on toy. The item was tested and working. The buyer admitted that their existing battery and charger were not working. I offered to help them, and advised a battery purchase (I don't sell those) but they only wanted to test the one battery they had, and said directly and specifically just that in an eBay message. They bought my working charger and then wanted to return it. They even expressly mentioned that the green and amber charging lights were doing the correct codes when I inquired. Working, period. They were reminded of the four places that my listing expressly states that I don't take returns. They filed a defect return, got approved, and sent back their crusty gross dead charger with soda spilled in it , brittle weathered cord left outside, sun damaged, with our item number sticker picked off the other one and put on this one. I called ebay and asked for an appeal and defect removal. An agent from appeals wrote later today "Monica" that the refund was owed to the buyer because the tracking said the return item was delivered. I never disputed that a package came, only that the item wasn't the one we sent out. They also said I should comment on the feedback, and that they can't remove it. I didn't need a feedback removed. It was a seller defect I asked about removing. So this time I tried to call, instead it said calls not available. Instead it let me use chat. Great, so I reiterated this all to them. Was told the case is closed. That they would "cascade it" to the other department, whatever that means, then disconnected the chat. It also said a copy would be emailed, at the bottom of the chat window, and that never happened.

 

People can not get away with fake return requests, and out right fraud.

Well I would definitely report the buyer to Ebay and note they need to review the emails between the two of you as it would be very telling.

To ebay, 'faulty returns' are 'a part of doing business' and a risk one takes.  They will admit that they don't know what you shipped out or what you received back. 

 

You can leave a complaint with USPS Postal Inspector (using the mail for fraud), IC3 and make police reports.  Still and all, if you read the boards here, you will see that it frequently happens that people get away with 'outright fraud', it would seem.

Not saying 'NO' doesn't mean 'YES'.

The foolishness of one's actions or words is determined by the number of witnesses.

Perhaps if Brains were described as an APP, many people would use them more often.

Respect, like money, is only of 'worth' when it is earned - with all due respect, it can not be ordained, legislated or coerced. Anonymous

Not much you can do through eBay in this case. Buyer could just has easily sent you an empty box and they would still have gotten their money back. I have had this happen once. There is no seller protection on eBay. Bottom line is eBay simply makes it too easy for the scam buyers.

I have had phone, then chat, then email contact. Still nothing from eBay. I've been largely ignored. The 'contact us' link is always a different method. How / can I reach appeals by phone? I feel no one at ebay understands this person sent back the wrong item.

eBay is not law enforcement.

Ebay may or may not understand it, but they are never going to believe your word over the buyers. There is no proof you can offer that the item you sent was not the item you received. 

 

It's basically called 'theft' and the buyer will get away with it. Nothing you can do but report them; if they get enough, they won't be able to 'refund' in the future.

Welcome to my world.  I don't sell as a hobby.  I sell to pay my bills this year and as far as I am concerned eBay assisted someone in ripping me off that ADMITTED to breaking the item I sold her.   She was able to say it wasn't as described, I guess because she didn't know she could break it??????????    I dont know when I will get over it, but the fact I opted not to accept returns was irrelevant to eBay.  They instructed me to select refund to get it back, then instructed me to select refund to close the case so I could file an appeal.  I got an immediate email stating my appeal was denied because I received the return and voluntarily refunded.   It was a complete betrayal to tell me I had to close the case in order to appeal, then tell me I could not appeal because I closed the case.

I quit dealing with any eBay via email or online chat.  Get them to call you even if you have to make up a different reason for the call.   Long story short, I still lost the money and am stuck with the broken item.  We should all take up a letter writing campaign to 60 Minutes to get them to do an investigative piece on eBay.

Also, I quit selling very valuable items on eBay unless I can possibly find another selling alternative first.
