Sold and shipped a Nintendo switch and buyer returned PLAYING CARDS!

Thats right! The real problem... ebay allowed it!

The buyer was refunded my money AND kept the Switch! I provided ebay with proof of purchase, a pic of what I sent, and the USPS tracking info. I filed a police report in my home town but they said they could not interact with the police in Puerto Rico. ebay said that was not enough proof that I did not send the cards and have denied all my appeals. I have sent 16 emails. had two chats, and three phone conversations and can not get a refund. I received a message from another seller saying this buyer did the same thing to them and another seller. What the hell is wrong with ebay? I guess I will have to move to the next step of arbitration with the AAA company.

This is exactly why I refuse to sell any electronics online. They are magnets for scammers. I'm sorry for losing your item and money and hope you can put this behind. Best of luck to you....

Just curious. What kind of feedback does your buyer have?

 

Was the shipping weight/postage of the return box consistent with a Nintendo Switch?

 

I would press the issue with filing a police report with the buyers local police. 

 

Gather what info/evidence you have and file an appeal with ebay. 

 

Other than that it seems like you did all you can do.  Sorry this happened to you.

 

Remember, never sell anything on ebay that you can't afford to lose.

I am sorry that you got scammed.  Always check out your buyer. I do.  I google map their address and name. I check their feedback. This obviously isn't foolproof but if I suspect a scan coming I would rather cancel the sale if it is a high-priced item and take an eBay ding. You have done a few of the things that I would suggest such as contacting the police department.  I would also advise the buyer that he has committed a felony with mail fraud. Tell him that you will be filing a report with the Postal Inspection Service. Putting a little pressure on the scammer never hurts.  Good luck.

eBay is not law enforcement:

They have no idea what you sent or what was returned. That is the why.

 

File with law enforcement as this is fraud and theft.

Unfortunately, ebay makes  buyer theft and fraud the seller's problem.  I am so sorry your were a victim of this. 

 

 I received a message from another seller saying this buyer did the same thing to them and another seller. 

 

eBay says that they will take action against an abusive buyer.  Also it has been stated that ONE incident does not constitute being an abusive buyer.  At least we get the idea here that THREE is probably OK as well before the buyer has to get a new ID????

Again, just about ANY item can be had for free by using a fraudulent claim.  It is the sorry state of affairs here where a click of the mouse is all that is needed to set it in motion.

I'm assuming you shipped with USPS. Do you have a copy of your label receipt showing the service you paid for? That will also show the billable weight.

 

Contrary to popular belief, USPS does get package weights at each scan along the sorting stations. This information is not part of the external USPS website tracking that we can see as customers. You would have to get the internal USPS tracking, that they are not required to give, but may if you ask nicely. Compare what you sent, versus what you received. Assuming the buyer didn't stack the package with magazines or something to give a comparable weight, and assuming USPS will provide the information I touched upon above, you should easily be able to appeal this is you do some legwork.

 

Well.... nothing is easy with eBay but still try and get that USPS information (nothing says you can''t ask at another post office if the first turns you down), file a police report (even if it does nothing the case number will help with eBay), file an IC3 report and get the case number, then try appealing the outcome. Speak with a person, never rely on their automated system.

 

Be very clear and detailed. I have won following this method.

I was afraid when i sold it because the buyer had 0 transactions so no feedback. I did not know if I could deny the transaction for that reason. 

 

The returned package was a Priority Mail small flat rate box. Clearly not big enough. Also only 11.3 oz.

 

I can try filing with the police in Puerto Rico

 

I have formally filed at least 4 appeals with ebay. All denied for different excuses.

ebay has full protection for buyers and no protection for sellers. without sellers, there would be no buyers. I reported the theft before ebay refunded the thief. Why was it not put on hold for an investigation? ebay asked me to file an affidavit. If they asked the buyer to do that they would not have received a response. The buyer has not responded to anything and I have a long list of communications on file for evidence.

 

I am not done filing with other forms of law enforcement.
