Any other small sellers from Texas out there? Do you have to have a sales tax permit even if you just sell a few things? I've checked the Texas Comptroller's website and the answer is clear as mud.
The comptroller's website discusses "selling online" vs. "selling through a marketplace (e.g. eBay)".
Under the "selling onlines" rules you don't have to get a sales tax permit if you are reselling items you originally purchased for your personal use and sell less than $3000 per year, which is me. I'm just selling my kids' used clothes.
Under the "selling through a marketplace" rules it says you must have a sales tax permit. Period. But it also seems to assume that anyone selling through a marketplace is a business looking to make a profit, and that's not me. I really just sell to try and make a few bucks back on my kids' clothes.
Has anyone else dealt with this issue? Are there any exceptions for marketplace sellers who are just selling a few things?

You do not need one, eBay will collect the sales tax from your state on your behalf & remit it for you. No need to worry. If I had to guess, 99.999999999% of sellers on here do NOT have a sales tax permit. Cheers. I live in NY & have never had one. Been fine since 2018 with no issues whatsoever, even my CPA said everything was fine.

I've asked the Comptroller's office directly. I'm sure I'll hear back from them in a couple of months.🙄
