You do not have the right not to sell on eBay.
Selling here is a privilege. eBay can take that privilege away at any point.
You have the right do you determine what items you are going to list. eBay has the right to determine whether or not you're actually allowed to sell them here.
You have the privlage to post any return policy that is within eBay terms of service. eBay has the right to override your return policy on a money back guarantee cases filed against you.
eBay has the right he determine what seller metrics should be in place and the right to enforce the ramifications that are listed on the site.
You have the privilege to come to the boards and complain. You do not have the right to free speech here because free speech only applies when the government is trying to tell you to shut up. You signed most of your rights away when you agreed to sell here.
But.. Wait! I PAY for RIGHTS here! That's what my listing fees, final value fees, and or store fees go to. Nope!
You are paying for the privilege. Rend your clothes, rally against the eBay gods, but it does not change the fact that you have privileges, and not rights.
I'm sorry if this triggers anyone, but the fact is, when selling anywhere, even your own private website, you have more privileges than rights.

Your last statement -as long as it is legal, on your own website you can list and sell as you see fit.

I doubt they are as restrictive as when you sell on a third party site such as ebay.
So it must be legal, but what other restrictions are you referring to.

Many hosting companies have prohibitions on pornography, weapons, drugs and paraphernalia (even legal drugs) ect.

Idea.......... Start your own e-commerce site and tell people that they can sell and do anything they want. See how far you can go with that.

You don't need to look any further than the eBay User Agreement.
"Additionally, we reserve the right to refuse or terminate all or part of our Services to anyone for any reason at our discretion."

I don't understand, eBay can't do anything to prevent me from not selling on eBay.
I, too, am having a hard time understanding do not have the right not to sell. For that statement to be accurate a seller would have to be required to sell on eBay and we know that this is not the case.
