Salex Tax charged to some sales only

Hello, I am a seller from California and notice some of my sales charged sales tax and some did not. Setting on all my listings were the same, I didn't check "Charge sales tax" box because per my understanding, Ebay will take care the sales tax portion.  Some of the items sold out of state.

I am just selling my personal stuff on Ebay, I am not a reseller. My concern is that the State will fine me for not charging sales tax on some of my sales.

My question is Do I need to do something on sales without sales tax?

 

Thank you all for your help and I am sorry if this already been asked before, I tried to search but could not find this type of question.

Likely that the no sales tax sales were to either one of the five no sales tax states or to one of the few states left that have not passed marketplace facilitator tax laws yet.

Or the sale was to a buyer in a marketplace facilitator state, but was in an exempt category; for instance, in my state clothing is not taxed.

The sales tax is based on where the item is being shipped to, doesn't matter where the seller is located.

Sales tax is ALWAYS driven by the state your buyer is having the item delivered to, not the seller's address.  The seller could be in the UK but if they ship something to you in California, sales tax will be added to the invoice by Ebay.

 

This will likely help you to better understand.  There is a list of 39 states that have Ebay charging the sales tax for them.
