Hello all. I don't think I have any recourse but thought that I would post here and see if anyone has been able to overcome this ridiculous set of cirucmstances.
I was looking for a place to sell an old MacBook Pro. Some keys were missing (but the keys were still working) and the touchpad responded to taps and not clicks. I know that the laptop wasn't a gem but it worked just fine. I fully explined the details of my laptop in the listing and followed every recommendation that eBay gave so that I would receive my price guaratnee. The item sold for less and now eBay is telling me that my item was not eligible due to the above stated defects. First they said that only New or Gently Used items are eligible. After reading the terms and conditions of the promotion to them, and not once encountering the words "New" or "Gently Used, their new excuse was that it should have been listed as For Parts/Not Working. I would not have listed the item for so low were it not for the price guarantee. I would have either kept the computer as it outperforms a newer MacBook Air that I have or sold it to the people who offered me a little less than the guaranteed price. While on the phone with "leadership at eBay," I found tons of listing from Top Rated Plus sellers that had missing keys or similar defects and listed the item as used. When I asked should I report these folks? The man told me yes. So he acknowledged that the terms of conditions were misleading. He acknowledged how a reasonable person would follow those terms of conditions and post their items relying on it and essentially said you're SOL anyways. So my question is, is there any other way that I can pursue to right this wrong? Or should I follwo eBay's advice and spend the next two hours ruining the livelihoods of Top Rated Plus sellers and report everyone listing an item as Used when it should be listed as For Parts/Not working?

That does not sound like something that works just fine. If ebay allowed a price guarantee like you would hope then everyone out there would be listing their junk and getting the difference from Ebay.

There are 4 requirements, you didn't comply with "c"
To be included in the Promotion, a Qualifying Listing must be a bona fide listing that includes: (a) a correct title that accurately reflects the Apple laptop being sold; (b) an accurate photograph of the Apple laptop being sold; (c) an accurate description of the condition of the Apple Laptop; (d) shipping costs that are the lesser of $15 or the average, usual, and/or customary range for similar or identical Apple laptops. Apple laptops that are stolen, activation locked, or otherwise unusable may not be included in the Promotion. Without limiting the foregoing, all elements of the Qualifying Listing must be truthful and accurate, and must not contain any words, messages, images, icons, or statements that have the effect of asking buyers to avoid buying the listed item (i.e., stating ‘Do Not Bid' in the listing description) or informing the buyer that the actual item is not as described in the title and photograph. Listings that contain any of the foregoing will be disqualified from the Promotion.
