I have a question that I can't find a definitive answer to. I was given several boxes of Dr Reddy's (formerly Habitrol) nicotine patches that I never used or even opened. There is no "not for resale" fine print and the expiration date is July 2024. Would I be facing possible legal trouble if I list them? I looked at the list of what's allowed and what's not as far as medical devices and it looks like it's okay but I can't determine for certain. I have seen several sold listings, but that doesn't necessarily mean that it's allowed, it could just mean that those sellers got away with it. Any advice would be greatly appreciated.

According to Tobacco and e-Cigarettes policy Nicotine patches are ok to list.
The following or similar items are not allowed:
- Cigarettes, cigars, nicotine pouches and loose tobacco
- Herbal cigarettes or herbal tobacco (sometimes called nicotine-free or tobacco-free cigarettes or shisha)
- Electronic nicotine delivery systems (ENDS) including e-cigarettes, e-liquids and e-cigarette parts
- Accessories for e-cigarettes
The following are exceptions that can be listed:
- Collectible/vintage packages
- Nicotine patches or gum
- Tobacco seeds
Activity on eBay is required to:
- Follow all applicable laws
- Respect the rights of third parties
- Follow the eBay User Agreement
- Follow this eBay policy
