New, but modified, item listing

I plan to sell an item that was intended for one purpose but has been modified for another.  Nothing illegal, dangerous, or anything like that.  Can I still list it as "new", or does it need to be "refurbished"?  It will now not be the same item as the part number listed on it, so how do I get around a requirement for a manufacturer's part number?  It will be a suitable replacement for a different part number (which is no longer available), if that matters.

If it did not come out of the factory that way imo it is not new.

 

Refurbished sounds right and be very detailed in the description to avoid confusion.
