So I sold about 8 people the same product over the course of two days, it's a powdered herbal product.
They all get it and I have no complaints, except for one that just popped up in my inbox today from someone who has had their product for over a week without saying a word.
They told me the following:
1. It was moldy and mildewy, my product made them sick.
2. The bags I packaged it in were open AND had small holes in them (They did NOT when I sent them, and I double bagged their product, so the chances of both coming open is unlikely. The small holes are also highly improbable because you'd literally have to poke the holes into the bag, I don't think you could do that by slinging the package around based off of how I packaged it)
3. They got rid of my product, so they're out the money and my product. At least that's how I'm reading this. (Perhaps to avoid a return ship?)
I find this all very unlikely because I know how I packaged what I sent and SEVERAL others have had their purchases for much longer than this particular customer's, and I've not heard a single word from any of them regarding mold or the bags being damaged.
Here is the exact message they sent me, with my commentary added in (like this)
Should I ask them to send me pictures? Should I offer a return ship?
This doesn't sit well with me, and it's not just because it's a refund. It makes no sense to me how what I sent could end up this way unless someone did something to it along the way. No one else has complained about this, even people who have had theirs longer than this buyer.
They also had it for a week and didn't say anything?
They have tons of good feedback, but I still don't trust this just because of the nature of the item itself and the complaints from the buyer. The listing got pulled after they bought it, so I'm not even sure they can make a claim on it because I don't even think it's in their cart anymore. Besides, they didn't even explicitly state that they wanted a refund, to me it seems more like they want me to replace/send them more of what they got.
Opinions?
I'm considering just ignoring this until I'm made to not do so, because I really don't believe this buyer. I also should add that what I sold them was listed as NOT FOR CONSUMPTION, and they made the choice to consume it.
Having said that though, it should not have been moldy or have made them sick. No one else has complained of that. The bags were sealed rather tightly, there was no moisture in them when it shipped, nor holes, and the way it was packaged would make it very unlikely for it to have been ruined in transit. If that were the case, they would have complained to me immediately after they got their product, not wait a week of sitting on it (and probably consuming it) to say something.

I should also add it makes no sense for them to not immediately claim they want a refund, and to word their message in such a way as to suggest that I should make this right.
(To me they're wanting more kratom, which when taken orally is psychoactive ((so it makes sense)) )
Yet if my product was so bad, then why wouldn't they just outright say they want a refund? Why wouldn't they have done this a week ago? Unless they've been taking my product and then decided they could get more for free off of me, or something went wrong in the week they had it.
Also, it doesn't make sense to me for so many things to have gone wrong. It's like, not only is it moldy, but the bags are ripped, and not only are they ripped, one of them was open.
I'm trying to use Occams razor here and I keep coming back to the point that I think she's trying to scam me into refunding her/sending her more. A lot would have had to have gone wrong for this to be truth.
The only thing I have to assume for it to be a lie is that she's lying!

Kratom is illegal in some States. Are you sure this is the hill you're prepared to die on? If something goes wrong and someone suffers a bad reaction they can sue you for everything you've got. I don't know why this stuff is still legal to sell on Ebay, if it still is.

That's understandable, I can't reasonably. I'm saying that my product shouldn't have been like that. It is very unlikely. It also wasn't like that when it arrived, they've had it 7 days, they would have said something as soon as it got there if it was as bad as they're claiming. I would have.
I'm saying this is too good for them because I can't justifiably ask for any evidence or a return ship if it's thrown away.

How could they sue me?
It's not legal on eBay, my listings got pulled.
I sold all my kratom with a specific label, NOT FOR HUMAN CONSUMPTION.
Even then, nothing I sold anyone would make them sick. I am very confident on that. They could have had a bad reaction if they took too much, but kratom in and of itself won't make them sick unless they're a very small percentage of the population that happens to react negatively with it.
In fact, most anecdotal evidence I've seen has suggested that kratom has health benefits if used responsibly.
Anyways, all of that is besides the point, I'm not here to discuss kratom, it's legality, it's effects, etc.
I'm here to ask about this specific sell, which has already been conducted.
I no longer sell kratom, but I already sold this person kratom. So I have to deal with what is happening now.

I'm not going to do that, because I really don't think what they're saying has happened.
I would rather them send me a moldy bag of product back so I know they're being honest. I'm telling you what they are claiming is highly improbable. Not impossible, but really not very likely at all.

Ok, this sale.
You asked for a photo, but they said they already threw the product away.
I wouldn't expect a photo now...
Sellers usually state they'll refund only if the item is first returned.
If they haven't opened a Not As Described case, then wait until they do so, then approve the return.

I would ask for pictures, or for the item to be returned. It will cost you money for the return. It is frustrating, but there is nothing else for you to do. If you suspect something was damaged in shipping, and it was sent priority mail, it is covered by USPS insurance.

Given that it's not legal to sell on Ebay and you're no longer selling it, I'd refund and move on.

The simply solution for a situation like this - if it is not a lot of money - and a lot of money depends upon you - Block the buyer. Issue a full refund to the buyer. Call it a day. Fighting with some buyers is simply not worth the aggravation and lost productivity even if you can win the issue in the end.

If you have it on record the buyer reporting they tossed the product , make sure you keep that message. Should your buyer open a return case, you can get the case closed based on the fact, she has nothing to return to you.
Its amazing when some buyers think they have the right to keep what they got and demand a refund. Bet, if you check with other sellers, this buyer has pulled this stunt more than once. You have the right to have your product back if they want a refund. No return equals no refund.
If what this buyer said, about the product was true , why not simply contact the seller prior to tossing it and say, I wish to return it for a refund. Because this simply process did not happen, I am very doubtful your buyer's story is true.
Keep it simple: Return For a Refund!
