I know this has been mentioned buried in other threads, but felt it deserved its own headline discussion.

I know Missouri has a $1200 threshold for 2021. However, when they sent out the 2021 for over $1200 this week, they also sent a 2020 as well for over $1200. Nothing was received last year for 2020.

The issue, is my 2020 1099k is about $450 more than what I had on my return. I sold my old iphone that sold at the end of 2019 which I claimed for that year. I did not understand the payment settlement date/sale date difference. If I had gotten this last year, I could have corrected it. Yes, I can prove this, but I rather not have to a year or two down the line. Now I am wondering if I need to amend 2020 return....I know, I know ask my tax rep. But first I want to know if this is just a snafu like the CA situation.

After I saw this, I checked my tax transcript on the IRS website and they didn't have the 2020 there..

Here is the question, was the 2020 Missouri 1099ks sent by mistake for eBay? Were the Missouri 2020 1099s issued by mistake like the CA snafu that for 2021? Will these Missouri 2020s be filed to both IRS/State (a year late). Its pretty crappy that these came out a year after that fact. If the threshold changed in 2021, then Missouri sellers deserve the same consideration as CA sellers just received.

I feel it is fair to have an official response on this. I'm sure other Missouri sellers have seen this and have contacted eBay, what has anyone heard about Missouri when they contacted eBay.

Missouri Law concerning 1099k's:

"All individuals, businesses and corporations who are required to file a federal 1099 information
report must file with the Missouri Department of Revenue an annual statement of payments of
any income of $1,200 or more from a Missouri source except:
• Wages from which taxes were withheld; and,
• Income reported on an information report for an S corporation or partnership.
Annual statements ARE required of any individual, business or corporation making those
payments to Missouri residents and nonresidents"

I spoke with an eBay rep that had a connection to those in the know. I was told that eBay's communication with Missouri left eBay uncertain about how to proceed so they erred on the side of caution and sent them out. The law seems very clear to me. Only send them out if the Federal threshold and the Missouri 1200 have been met. I believe that eBay should revisit their decision as they did in California.

This whole 1099K mess gets uglier every day.

Wait until next year when the whole U.S. gets them - I am sure the polls will look fantastic.

And of course, they won't get the new ones until after the midterm elections because OF COURSE.

I did not know that they had to be sent out only if the federal and the state requirements have been met. I too received at 1099k for 2020 and 2021 on the same day. Federal conditions were not met in either year, only state. Does this mean I will have to amend my 2020 taxes at my own expense? If it comes out to me owing a lot more money that what I already paid in I will be coming to ebay for payment reimbursement for failure on their end to send the 1099 in a timely manner for 2020.

It's not "federal and state" it's federal OR state, you've been told before that the MO threshold is $1200

I'm not sure why you would receive a 1099 for 2020 unless it was actually posted to your account last year but you never checked given you thought you would not be receiving one. The one you just received for 2020, was that by snail mail or downloaded from the Seller Hub?

I can confirm what others have stated, as of Jan30, 2022, a 1099K download link appeared for both 2020 and 2021 (they both say generated 1/30/22), however, in the mail, only the 2021 was received. There was nothing there prior to that date because I had been checking since I knew I would get one for 2021 for about $1500. Luckily, the 2020 1099 was a few dollars less than what I had on my return. So if a Missourian only goes by what they get in the mail, they will never know about the 2020.

I've been on the phone not stop for 2 weeks and ebay still wont'/can't answer why a 2020 1099K was sent, get the 2021 because MO passed the law supposedly mid year, still can't get a straight answer on that one. But if anyone figure's out about 2020 please post.

I haven't got a clear answer from Ebay. The reps are telling me the 2020 forms are a mistake and to disregard it...but I want to make sure that it isn't being sent to the IRS. I get that 2021 is correct due to a Missouri law change but just now sending a 1099 for 2020 in 2022 has to be a mistake. Ebay was required to send those way before now. Does anyone have a clear cut answer on why Missouri sellers received a 2020 1099?

That's what we're trying to find out too, paypal didn't send a 1099 for 2020(half/half that year). It'd be in ebay's best interest to drop the 2020, there's a HUGE fine for not supplying a 1099k esp. a year later. If my friend has to amend her 2020 taxes, her accountant will file a complaint.

This isn't a "clear answer" but it might help.

While the deadline for eBay to provide the 1099 to YOU was January 31st, the deadline for eBay to send the 1099 info to the IRS is Feb 28th. Most companies who issue 1099's follow BOTH dates so is it very likely that eBay has not yet sent any info to the IRS and if the 2020 ones were issued in error there is plenty of time for them to remove them from their submission to the IRS which almost certainly has not happened yet.

Yea we're running out of time, she got the 2021 but they haven't mail the 2020. Called ebay several times and can't get a straight answer, said a ticket was made but the guy said honestly their still cleaning up CA's mess.

According to Missouri law, it is Fed AND State. I'm confident that eBay mistakenly sent out 1099's to sellers that didn't meet the Federal thresholds in 2021. Who knows why they sent out 1099's for 2020 to sellers who didn't meet the Federal thresholds. They should retract them both.
