Just got scammed with a fraudulent return $1200

My buyer claimed my item was defective (it wasn't) and issued a return.  I knew the item he sent back wasn't what I sent him because the weight was almost 30 lbs lighter when i saw his tracking information.  At this point I knew i was getting scammed so i had someone film me opening that package to find my item wasn't returned.  I called ebay to let them know but they didn't care.  I submitted a police report and everything they requested but in the end they saw that a package was delivered and that's all they cared about.  They issued him a full refund and now i am without my item.  I have an appeal open but they are just asking for the same stuff i provided last time.  They don't even want to see the video or pics of the fraud.  It's extremely frustrating and at this point i am more upset with ebay than i am the guy who scammed me.  anyone have any ideas?

When you call, you need to ask for the supervisor. When reaches the supervisor, you need to ask for the manager. It is the Manager who can help you with this. The other person do not have any ability to get your money back.

They have Trust and Safety specialists who deal with high-ticket cases.  Ask to speak to one of those staff.

You will have to pursue this legally. Fraud across state lines can be very serious business if you can prove your case. More people who do things like this need to be put into their place.

Sorry this happened to you and it does suck.

As far as taking a video, it can't really prove anything because it can be faked to easy.

Ebay never see's the item, seller says they shipped to the buyer.

They never see the item seller claims the buyer sent back.

When buyer claims INAD, thy are almost guaranteed to get their money back, doesn't matter if they send the correct item back or not.

You can report the buyer for abusing the MBG, also file a mail fraud claim and you might be able to file a police report where the buyer lives.

You are attractive to scammers because you are new to selling (at least recently) on ebay and selling expensive items.

 

How sad that there are people like this.

To add insult to injury, the scammer called you a scammer, if that's the item. These types of people are "bottom feeders".

 

Watch out for spoofed paypal emails too, claiming the buyer paid, so always log into your own account to verify.

 

Just an opinion... I generally will not list anything over $100 here on ebay on my selling account; if an auction goes beyond that, fine. That's just my risk tolerance level, because of your experience and other scams,  I sell expensive items locally, face to face. That's just me though. Many are fine with selling items that list for thousand$ on ebay, and maybe never have problems.

 

With ebay, they generally favor the buyer, no matter the truth or lie, but maybe an appeal will work, especially that ebay has proclaimed or pretend to proclaim better seller protection.

 

Some people here who have been in the same or similar situations, say they file a police report (which you did), and/or notify the scammers local police of their experience just to let them know. Some here also have reported filing a case of mail fraud with the USPS. I hope others offer better advice.

THe first rule of fight club...I mean...feebay....I mean e bay....is NEVER EVER NEVER NEVER list something you cannot afford to give away.

Did you ship the item or was it local pickup?  The listing shows it as a local pickup.  What was the item you got back?

Ebay puts a limit on the number of items a person can list - they need to put a cap on the value instead. We too often see unsuspecting newbies taking for granted that the internet is a safe place to conduct sales like this.

 

You been given advice to make reports and you should. If you aren't too far away from the buyer - I'd file a case in small claims court. For that amt of money - it would be worth the trip. I doubt very much that you will ever see that money again. And I'm really sorry to say that. The old adage - never sell anything you can't afford to lose - are words to live by if selling items on online venues. Local sites provide the safest protection for high value items.

I thought the OP was talking about the (almost) $1200 speakers in their sold items

listed with FREE Economy Shipping. Am I mistaken?

What weight should or is given to an official business record indicating a nearly 30 lb weight disparity, submitted as supporting evidence, to ebay ?

Did you submit a police report to your local jurisdiction or to the buyer's jurisdiction?

 

If you did it locally you should ALSO report to the police station closest to the buyer because your local precinct has no jurisdiction over other regions (find it on the Web).

 

Also, file a mail fraud report (USPS takes this seriously) regardless of how the package was shipped (they cover fraud for all carriers). It's easy, they have a form.

 

AND fill out the fraud report on the FBI site if the buyer was in another state. Also a simple form.

Not sure why on every scam thread someone feels the need to state this.  I doubt the OP is going to become homeless because of this.  However, it doesn't make it any better.  Stealing is stealing.  Bill Gates can afford to have a BILLION dollars stolen from him, yet I'm pretty sure if someone did he'd try to do something about it.
