Item got pulled, yet I see multiple LONG TERM sellers selling the item for months with no moderation

So I was selling Kratom.

 

Apparently even though it's legal in most states, it's against ebay's policy to sell psychoactive compounds.

 

Okay, understood, won't happen again, shoulda read before I listed it, got it. Nothing else to be said about that.

 

Yet, I go and check the listings for Kratom, and there are SEVERAL sellers who have been up for MONTHS who I KNOW have been reported. 

 

But these sellers keep their listings??? How? Is ebay cutting some of them a deal or something?

 

Don't tell me "They just haven't got caught yet" because that's simply not the case. Someone has had to have reported their listings over the MONTHS they've been selling. I've seen entire pages of Kratom search results go down because of removal, yet these listings STAY each time. It's not a relist, it's the same listings.

 

In fact, they're THE TOP RESULT OF SEARCHING KRATOM/Mitragyna Speciosa. So I HIGHLY doubt that these listings have not been seen or reported, whereas a TON of listings that were not the first search results have been removed. Literally pages of listings AFTER the top results.

 

 How? Can someone explain this to me? Explain it to me besides saying "They just haven't been caught yet" because that's simply HIGHLY unlikely.

 

Don't lecture me on selling Kratom, ebay already did it, and it won't happen from me again.

 

I'm just curious how these other sellers are doing it, and have been doing it for months surviving MULTIPLE pages of listing removals when they are the TOP search results CONSISTENTLY.

 

Anyone? Sorry to come across as confrontational, I'm not. I'm just not here for lecturing, and I know why MY listing was removed, I'm just curious as to why these other people seem to be able to list it for MONTHS, be the TOP RESULT, and survive MULTIPLE pages of removals spaced out WEEKS apart.

 

That really, really does not make sense to me at all.

Apparently a very small number of sellers are being tolerated to sell this product. 

 

It appears you are too late to be included within this group at the present time.

 

Perhaps there is a waiting list when a future spot does become available.

eBay is fickle and capricious when it comes to restricted items.

 

Nobody knows the why or how of it. Some sellers' items get pulled immediately, some can sell one or two and then get pulled, some can't post the item at all ... but other sellers seem to be immune.

 

Some liken it to speeding.. You got caught today. Somebody else will get caught tomorrow. Others have a really good PBA card in their wallet.

 

Don't try to relist the items. You are on the radar now.

 

Just because there are other active listings does not mean it it allowed to be sold.

 

One of my mom's favorite things to tell me when I said "but everyone else is ..." was  "If everybody else jumped off a bridge, would you jump too? Have some common sense!"

Sometimes a listing gets on eBay's radar because of HOW it is listed, rather than WHAT is being listed.

 

But without seeing your listing side-by-side with one you think should be taken down, it would be  impossible for us to determine whether that might be the case.

 

For instance, there are many substances that are permitted on eBay, as long as the seller does not make certain claims about the substance. I can list parsley on eBay, and there are lots of people who do. But if I say in my listing that parsley provides a "legal high", I am violating policy eBay's drugs policy even though the substance is not a drug and the listing would be perfectly compliant without that statement.

 

I'm not necessarily saying this is the case with your listing - I'm just commenting in general that sometimes it is the nature of the listing that results in a policy violation, rather than the nature of the item. And unfortunately when eBay takes a listing down, you often get a form letter than may not really explain the situation very clearly.
