My laptop functions perfectly. The only thing is that the touchscreen does not work (but it has a keyboard and touchpad that work perfectly fine) and it does not come with the original pen. Do you think I'll get into "trouble" if I list it under "Used"? Let me know, thanks!
What I mean by "trouble" is someone who buys it and has a problem with it.

Did you accidentally turn the touch screen off in the settings?
Or maybe it's set up to only turn on the touch screen when in tablet mode(basically having the display flat on the other side of the keyboard)?
There are settings regarding both of those and more above.

@luckythewinner Uh, I only said "perfectly" so the repliers could understand the condition of the laptop. Obviously, in the eBay buyer world, I wouldn't say that. But basically, the laptop has no other flaws at all and would be "like new" if it weren't for the dumb touch screen.

just swap out the digitizer with a new one, and sell it as working. They are not that hard to swap, bet you can find a youtube tutorial out there. Just have to pot the bezel off the screen, and it's right there. Need some non marking pry tools and small screwdrivers and about 15 minutes in time. The part is normally pretty cheap, will make more if you fix it

If you list it as used, you will regret it, as you will end up with an unhappy buyer and return / refund problems to deal with.
eBay defines used, and shows this definition in every listing for the buyer to read, as: "Used: An item that has been used previously. The item may have some signs of cosmetic wear, but is fully operational and functions as intended."
Your laptop has more than cosmetic wear. It is not fully operation. It does not function as intended. It is not merely "used."

You came here for advice about how to list an item that is not fully functional. 100% of the responses that you got here told you that an item that is not fully functional does not qualify as "used".
All that aside ...
You are free to list it however you choose. It is possible to say that it is "like new", or that it is "still sealed in the original box" or even to claim that it is "made of pure gold". eBay will not stop you from misrepresenting the item.
And if your buyer is happy with the item and does not file a case, you will be fine.
All we can do is advise against it.

Well, it does not qualify as "perfect." It certainly qualifies as "used" in the colloquial sense, though technically not in eBay's definition. 😁
To the OP: it would help to make absolutely certain that you haven't simply deactivated the touch screen somehow, and that it really truly is dead. If so, you need to make that honkingly obvious in the listing (perhaps even sticking a PostIt note on the screen reading "Touch Screen Not Working"), and even then you run the risk of a Not As Described return request, even if you list it as Parts Only.
It's also possible that you will find a buyer who doesn't care about that (e.g. I own an HP Pavilion TouchSmart Notebook and never use the touch screen; I mostly forget that it's even there), but there is still a risk. Local Pickup Only might be a safer option, since it would be hard for the buyer to claim NAD when its shortcoming is demonstrated right in front of him.
