Is Posting a "BUY TO WIN SWEEPSTAKES" Banner in your eBay Listing Against eBay Policy ?

I see a Seller advertising in his listings a Banner advertising " BUY TO WIN SWEEPSTAKES" and next to that it shows t1 of 3 prizes a Buyer could win. Is this against eBay Policy ?  Because if it isn't i may try to post something similiar in my Listings.

The banner links to a custom Store page where the rules and conditions are posted ... 

 

Since it isn't a "listing", I'm not sure if It falls under the  "Chance Listings" policy or not?

Contests or sweepstakes and the like are against policy. It reads as follows:

 

"I’ve seen eBay running contests and giveaways, can I?

Sometimes, we, or our approved partners, will run contests or giveaways on eBay that follow all applicable laws. However, seller listings and products that promote giveaways lotteries, sweepstakes, random drawings, raffles or contests aren't allowed.”

Definitely against the rule, but let me specify that would be the rules the rest of us have to follow. With 36k feedback I doubt anything will be done about this seller. They have a whole different set of rules, or lack of I suppose.

Yea, I Agree. Sometimes these Large Top Sellers don't seem to abide by the rules like us smaller sellers do. Totally Unfair ! I contacted eBay about a year ago about what this seller is doing and up to this point they haven't done anything to stop what this seller is doing. I contacted Customer Support twice last week and they say they are investigating this seller. I told Customer Support if this seller continues to get away posting this "BUY TO WIN SWEEPSTAKES" and nothing is done about it, Then i will do the samething...........

Contacted eBay about what this seller is doing and their investigating this. If nothing is done in a few weeks i told eBay i will do the samething. Why is this seller the exception ?

Thanks for the info. This seller has been getting away doing this for a Longtime. Contacted eBay Customer Service and they said their investigating this seller. If nothing has changes in a few weeks i assume it's okay and i will do the samething......

Running an unlicensed sweepstakes or lottery is agains the law.


Running a contest (which is a test of skill) is not against the law but it IS against policy.
