So the irs sent my brother a cp2000 notice claiming he did not file 1099k in 2017, he didn’t have a 1099k in 2017 and I did, I filled my taxes to report my 1099k, so the problem here is that irs sent a notice to my brother claiming he did not report a 1099k from paypal in the amount of 76k in sales, the exact amount of my 1099k, how is it possible for them to claim he has a 1099k that appears to be mine, when we have different names and social security numbers, we shared the same address and same last name but that’s it, anybody has gone trough something like this and how you guys resolved it. They want him to pay over 36k in taxes

I would start first by contacting the IRS and telling them.

This isn't really the place to get advice for such a serious matter. Your first step would be to contact the IRS and explain the situation. If that did not resolve the issue, then you need to go and visit a CPA / Accountant that specializes in taxes to help you with this matter.

No my brother did not sell on eBay so I’m sure there’s no 1099 k for him they just got the amount on my 1099k and put it in his account, just because they are the government they can get away with anything they want even do mistakes at the expense of others,,,, i gave my brother a copy of my 1099k and have him send it along with a letter explaining the situation still no response after a month.

Mistakes happen. Have you tried calling them yet?

Yes he called them
and they said we have to wait for them to reply by mail, so basically we cant do anything for now, and my brother works a seasonal job so he gets unemployment while he looks for a job and they denied his claim because they said he owes money to the irs, so this is being tough on him and is just unreal, so I don’t know how common this mistakes are but just don’t know how they associate my 1099k with him just by our address they must be more sophisticated than that

I wouldn't wait. I'd be all over this. I'd get a professional and just get the matter fixed. It sounds like your brother's situation is important enough to spend a few bucks and get a professional involved so you can get it resolved faster.
If you had a CPA do your taxes, contact them. They are likely able to assist you in this matter or know who you need to talk with.

it never is. But that is why we have to keep books. Gross is just that, gross before adjustments for costs, refunds, etc. Normal stuff when running a little business.

Listen mistakes do happen all the time. The IRS is run by humans at the end of the day and they very often make errors, so do computers. The good news is everything has a solution.
You need to get professional help with this. You should start with whomever did your taxes as most often they will also provide the customer with assistance for any IRS related letters. If you did your own taxes then hire a CPA to assist you. Since your brother's current income is being affected, you have more need to resolve this quickly.
I once received a somewhat threatening letter from the IRS saying I owed back taxes for some stocks I sold. I immediately paid without questioning the letter as I mistakenly thought the IRS knew everything. Lucky for me I then showed the letter to my accountant who explained the IRS was incorrect. They showed me how to get the proof that I didn't profit and they sent a second letter on my behalf. Eventually I was refunded what I paid as they were in fact wrong. So it paid off for me to ask a pro. You also need to get on this quickly because the longer you wait, the longer it will take to resolve in your favor. Best of luck to you....

You need to speak to an IRS agent in person. They don't do business over the phone. Locate your local IRS office. https://apps.irs.gov/app/officeLocator/index.jsp
You and your brother make an appointment together. Bring along tax records and identifying information. They can get it squared away for you. The sooner you do this, the better.

The IRS uses social security numbers to track your earnings and income.
Paypal asked for social security information to provide the 1099K. At some point, if you are a business and had enough sales, paypal would not allow an account to receive monies until a number was provided. OR you provided the SSN when you set up the account.
Paypal provided that 1099K information to the IRS. They used the registered owners information including SSN to send the IRS.
So now you have the IRS contacting your brother because they think he made the money reported by Paypal to them.
Is there any chance you are using your brother's paypal account?
Did you provide your brother's social security number to paypal?
Is the paypal account that you used properly registered with your information and social security information?

I agree; IRS goes by the SS # first, the name is secondary. Check the 1099k to be sure the correct SS# is on it. That 1099k had to have his SS# on it, for the IRS to link that number as not having reported the income.
The OP could have reported the income, did a Schedule C etc. and the IRS would not blink that they did not get a matching 1099. They look at it as 'hey, this guy is reporting more income than we show, but we don't care, it's more $'.
