on May the 5th I purchased an electronic device from a U.S. seller.
The item was new and never opened
I live overseas, delivery took a few days short of a month.
The item turned out to be defective and upon contacting the seller
which was helpful offered me to return and exchange for a new one.
It will take a good 5-6 weeks (two and a half months from the initial transaction)
untill I get my working item.
Here's where I need help...
Should I send it back a for an exchange or should I go through the
refund process and have the seller "Re-Sell" and start a new transaction set up?
On one hand I will lose all buyer protection, on the other hand, ebay always tells
us to "work it out with each other"
Your thoughts !!!!

If it were me I would want to keep my buyer protection. First one was defective, who's to say the second won't be as well?

Only way to protect yourself is to file an INAD case. This is not your fault, so protect yourself first
Seller will have to send you money for return shipping, and then refund you in full when they get it back.
Make sure it is returned to the seller with tracking.
If you do anything else, you can go through Paypal but will have to pay return shipping.

Requesting a refund may be best because you tie your money up for a long period of time, again, and you may not get anything better than the first item received, if you even receive anything.
Open a not as described case as suggested for your protection. You didn't create this situation, and you have tried to work with the seller.
