I listed an item as new by mistake, though mentioned it was used in description

I listed an item as new by mistake, though mentioned it was used in description.

The item sold before I noticed the mistake.  I immediately reached out to the buyer to let them know my mistake and see if they still wanted it.  But I am not getting any reply.

My deadline to ship it is today.  Should I just ship it?  I mean I guess I have no other choice as far as I am aware.  I just do not want to end up with an angry buyer filing a "not as described" case against me with ebay.

This is the listing

You do have other choices.

 

For instance, you could cancel the order as 'out of stock' or 'mistake in the listing' (or whatever applicable options there are, I don't remember) and take the hit right now. 

 

You could also take the hit on shipping late by waiting a little longer to see if your buyer responds.

 

I guess I would take an honest look at my listing and decide whether someone would really pay that money for a used item instead of a new one.

 

Just because you listed mentioned it as used in the listing you cannot assume your buyer paid attention to that, because he has the eBay Money Back Guarantee to protect him if it turns out not to be new.

That's a bad idea.

Now you'll have an angry buyer AND an angry eBay.

IMHO you'd be better-off waiting a day or two to hear from the buyer, so you might be able to cancel on the basis of "Buyer requested" which won't put a defect point on your account.  If you cancel based on out of stock or not available, you'll get a ding on your account which is must worse than a late-shipping mark.
